The European Commission had announced this trade-policy instrument under the Green Deal in 2019 as a means of implementing more ambitious climate-policy goals without energy-intensive sectors transferring their emissions abroad (carbon leakage). The CBAM proposal envisages imposing a levy on imports in certain energy-intensive European sectors that is proportional to the carbon content of the goods concerned. The proposal complements the EU's existing Emissions Trading System by requiring importers of goods purchased from especially energy-intensive sectors (steel, cement, electricity, fertiliser and aluminium) abroad to purchase carbon certificates based on emissions data from abroad. CBAM is primarily designed to promote an ambitious climate policy for the EU. However, the EU's current proposal creates the impression that it is mainly about improving domestic competitiveness at the expense of climate-policy effectiveness and development prospects.The draft legislation must now be fleshed out in detail by the EU member states and the European Parliament. In addition to addressing climate-policy effectiveness and compatibility with WTO legislation, account must also be taken of the impact on European trading partners, and, in particular, poor developing countries. Many developing countries are expected to face additional export costs as a result of the CBAM. The EU should carefully evaluate the associated disadvantages for developing countries and work towards achieving a development-friendly design of the mechanism. Corresponding improvements should be made to the CBAM in the EU's legislative process going forward: The EU must ensure that the border adjustments do not have a detrimental impact on poor countries. Least developed countries (LDCs) should be exempted from the CBAM. The EU should provide targeted support to the developing countries affected by the mechanism, for instance, by building their capacity for implementing the CBAM and for reducing carbon emissions in the sectors concerned. The EU should assist low- and middle-income partner countries with the decarbonisation of their manufacturing industries. The EU should also recycle revenue from the CBAM by deploying it primarily for climate-policy purposes abroad. The affected countries should be involved to a greater extent in future through consultations and diplomatic dialogue in the process for further developing the mechanism.

Book excerpt: Forty-nine million people live in the Lake Chad region, exploiting its rich natural resources and relatively constant supply of water, fodder and fertile land all year round. The area used to be a food production hub, with local markets supplying produce to Cameroon, Chad, the Niger and Nigeria. However, poor natural resource management, poor coordination across the different countries of the region, and the widespread impact of climate change have contributed to the significant deterioration of the Lake’s natural ecosystem capacity. Agricultural soils and pastures have been widely degraded, leading to a huge reduction in food productivity and, thus, job opportunities, especially for the youth living in rural areas who account for a high percentage of the population. Conflicts and tensions have created a conducive context for young people in search of income and opportunities to join the Boko Haram terrorist movement originated in Nigeria. This evaluation was conducted to address FAO’s response to the Lake Chad Basin crisis, including interventions conducted in 2015‒2018, as FAO published the Lake Chad Basin Crisis Response Strategy (2017–2019) to address the needs of the identified 6.9 million people affected by soaring food insecurity in the Lake Chad Basin in early 2017. The objectives of this evaluation were to analyse FAO’s responses to the crisis at operating level, with a focus on efficiency, effectiveness and sustainability, while assessing the relevance and consistency of the regional approach from a strategic perspective. The evaluation team visited many of the areas concerned, and at the end of each visit they organized a debriefing session with the respective FAO country team to share information gathered and collect complementary data and analysis to inform its deliberations. This helped to ensure transparency in the data collection process and to maximize the learning process. For FAO to support the food security and nutrition of communities in the Lake Chad region effectively, a regional strategy focused on supporting the resilience of communities is relevant and appropriate. Complementary to FAO’s country-based programmes, a regional strategy bears the potential to devise interventions that adapt to the cross-border nature of issues that each country faces and would allow supporting a more cohesive and collaborative way of working. Based on the Regional Response Strategy (2017–2019), FAO should revise its strategy and approach by incorporating governmental objectives, and translate it into an operational action plan, in line with other partners’ strategies in the region.

This study looks at the existing rules and provides recommendations for the revised guidelines to effectively contribute to accelerating the decarbonisation of Europe’s economy. It calls on the European Commission to pursue a combined approach that looks at reinforcing both common objectives and specific State aid measures. Since the approval of the latest Guidelines for State Aid for Energy and Environmental Protection (EEAG) in 2014, the EU institutions have agreed to accelerate the decarbonisation process to reach a climate-neutral economy by 2050. This strong impetus heavily influences the energy market where we see new economic models and types of actors emerging, and where there has been significant technological progress over the past years. The energy and environmental protection State aid guidelines no longer reflect the market’s reality and need to be revised carefully. As Brussels is about to kick off the revision of the EEAG, this report provides recommendations for new rules that effectively contribute to fast-tracking the transition towards low carbon energy systems in a cost-efficient way. Above all, Brussels should align the new rules with its 2030 climate and energy transition targets. “The EEAG reform should combine approaches that look both at common objectives and specific aid measures. This requires a significant evolution of the current regime whilst ensuring smooth continuity. Defining clear criteria to assess the contribution of a specific State aid measure to the ‘common interest’ is of utmost importance. The revised EEAG should strengthen these assessment criteria, including for specific aid measures. They must promote technology neutrality and consider the energy system’s resilience. Among the assessment criteria, the application of the proportionality test should be improved.” - Catherine Banet, author of the report The Guidelines are part of a bigger ecosystem of rules. The EEAG work in close interaction with the general block exemption Regulation (GBER) which allows the Commission to exempt prior State aid notification – and approval – in specific cases. This has proven to be efficient and should be maintained. If, during the review, a different approach is chosen, it may impact the entire architecture of the hard and soft law ecosystem of the EU state aid regime. The Clean Energy Package for All Europeans is a driver of the reflection behind the revision of the Guidelines. The scope of application of the EEAG should reflect and build upon the provisions laid down in this package. At the same time, the new Guidelines have the challenging task of anticipating the impacts of moving climate targets from the European Green Deal and the upcoming rules to achieve them, such as the revised renewable energy directive, the revised alternative fuels infrastructure directive, the implementation of the sector integration strategy and the Hydrogen strategy. Finally, enforcing the rules is just as important as setting the right rules. The report notes that, on several occasions in its recent case law, the Court of Justice of the EU has reversed some of the European Commission’s approval decisions, with major impacts on markets. The revised Guidelines should be set and applied so as to eliminate the risk of reversals of the Commission’s decisions as much as possible. “The COVID-19 crisis is just one example of the deep uncertainties and changes our society is going through. Europe should be prepared for more disruption. We need to build a more resilient energy system that can cope with such unexpected external shocks.
