Book excerpt: This book explores the private law implementation of the new international and EU regulatory framework targeting decarbonisation in the shipping industry. Compared with other sectors, the shipping industry has traditionally been labelled a 'slow mover' concerning the sustainability agenda. However, new regulatory measures on carbon reduction both internationally and in the EU require fundamentally new developments in the industry. This book focuses on the goal of carbon reduction from a private law perspective and considers how the new regulatory framework can be implemented in the shipping industry. This book studies existing contractual provisions in charterparties and bills of lading alongside new contractual model clauses designed to facilitate carbon reduction. It considers how the new clauses should be interpreted, whether they will transform traditional shipping contracts into more collaborative contracts, and how they will interact with other clauses in the contract and with other contracts in the supply chain. The contractual analysis is considered in context, reflecting on enforcement issues, such as Port State Control (PSC), the Poseidon Principles, and climate change litigation. The book also analyses the related topic of shipping contracts for carbon storage as a necessary means of meeting carbon reduction targets. Book excerpt: The combination of the Port State Control system that is currently in operation and the tactics employed by the International Maritime Organization (IMO) for the introduction of rules and regulations for safety and pollution prevention at sea, led to the establishment of a system which has the potential to bring about significant changes. These changes extend beyond the area of safety and pollution prevention, reaching areas lying entirely beyond the scope of IMO, and actually affecting directly private maritime law. The relevant provisions of the law of the sea are outlined, in order to define the legal framework within which the regulation process for matters of safety and pollution prevention may operate. Special reference is made to the development of the concept of Port State Control and its emergence as a new, alternative method of enforcement under the guidance of IMO. The study focuses on the modus operandi of IMO and critically evaluates the tactics employed by the organization in pursuing its ends. The book also examines the practices employed by influential port states in enforcing international regulations, and it assesses the reactions of smaller states with large registries, as well as the different sectors of the industry to these developments. These developments will lead to new legislation in the contracting states, with the potential of changing the principles of private maritime law. The author also draws attention to the impact that the ISM Code and the STCW '95 may have on issues of private maritime law, through an analysis of the use of English maritime case law. Preventing accidents and establishing a safer world without accidents is an important agenda for the maritime industry. Since the enforcement of the International Safety Management Code in 1998, companies have taken various kinds of measures to prevent accidents. Unfortunately, measures have been undertaken in a disorganized manner, and have not been effective. Experts of risk management, the safety management system, and accident models have each undertaken accident preventive measures within the scope of their specific fields, but have not looked beyond the realm of their own fields. This book discusses systematic accident prevention by integrating multi-disciplinary expertise based on academic research, the quality management system which has already proved its effectiveness in other fields, and findings of the author’s research. In systematic accident prevention, the weaknesses of a system within which accidents and incidents have occurred are viewed by combining scientific accident investigation data based on the International Maritime Organization model and the accident model. The nature of every type of marine accident, such as collisions, groundings, occupational casualties, etc., are derived by combining the accident model and statistical data. System weaknesses are rectified by the risk reduction method of risk management, and the rectified performance is incorporated in improvement in the system by the PDCA cycle, which is the core of the Safety Management System. We can see the weakness in the system and reduce the number of accidents and incidents while utilizing limited resources optimally to prevent accidents and incidents.
