Book Insurance Contract Law Between Business Law and Consumer Protection

Download or read book Insurance Contract Law Between Business Law and Consumer Protection written by Helmut Heiss and published by Dike Publishers. This book was released on 2012 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The topic of "Insurance Contract Law between Commercial Law and Consumer Protection" was discussed within the section on commercial law at the XVIIIth International Congress on Comparative Law 2010, which was held in Washington DC. It dealt with the fact that insurance contracts are commercial transactions, as well as consumer contracts. This is confirmed by economic data showing that the premium income derived by insurers from consumer insurance is at least equal to the amount of income generated by selling commercial insurance. The way in which insurance is legally classified appears to depend very much on the legal tradition of the country in question. There does, however, seem to be a tendency in the legal field to follow the gain in economic weight of consumer insurance. Nevertheless, most countries do not yet have a formal consumer insurance law. Rather, policy holders are protected by mandatory insurance contract law, even if they take out insurance for entrepreneurial purposes. "Consumer law" predominantly enters into the area of insurance law in two ways: (1) general consumer contract law is very often also applicable to insurance contracts, and (2) consumer insurance disputes are increasingly being submitted to mechanisms of alternative dispute resolution, such as insurance ombudsmen schemes. Ombudsmen institutions especially appear to be a source of consumer insurance contract law because over time they create a distinct set of case law principles for consumer disputes. These aspects are covered in this book, comprising the General Report, as well as the National Reports, presented at the conference in Washington.

Book Consumer Litigation and Insurance Defense

Download or read book Consumer Litigation and Insurance Defense written by Willy E. Rice and published by Cognella Academic Publishing. This book was released on 2016-06-24 with total page 832 pages. Available in PDF, EPUB and Kindle. Book excerpt: Consumers commence thousands of defective-trade-and-products lawsuits. Many consumers prevail but they never collect damages. Often, insured offenders do not have "deep pockets" and insurers refuse to pay damages on their behalf. Law schools offer consumer-law courses, yet numerous law students and practicing attorneys never appreciate the significant relationship between consumer law and insurance defense. The absence of casebooks discussing that relationship is the culprit. Consumer Litigation and Insurance Defense is a novel casebook. It fills that void by presenting a comprehensive analysis of state and federal consumer-law and insurance-defense decisions.

This book was released on 2018-04-02 with total page 161 pages. Available in PDF, EPUB and Kindle. Health Care Utilization as a Proxy in Disability Determination identifies types of utilizations that might be good proxies for "listing-level" severity; that is, what represents an impairment, or combination of impairments, that are severe enough to prevent a person from doing any gainful activity, regardless of age, education, or work experience.

Book Discrimination Vulnerable Consumers and Financial Inclusion

Download or read book Discrimination Vulnerable Consumers and Financial Inclusion written by Cătălin-Gabriel Stănescu and published by Routledge. This book was released on 2020-12-28 with total page 291 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book addresses the questions of discrimination, vulnerable consumers, and financial inclusion in the light of the emerging legal, socioeconomic, and technological challenges. New technologies – such as artificial intelligence-driven consumer credit risk assessment and Fintech platforms, the changing nature of vulnerability due to the ongoing COVID-19 pandemic, as well as the sophistication of digital technologies, which help circumvent legal barriers and protections – necessitate the continuous study of the existing legal frameworks and measures that are capable of tackling these challenges. Organized in two major parts, the first addresses, from multiple national angles, the idea of a human rights approach to consumer law, in order to replace the mantra of economic efficiency that characterizes financial services with those of human dignity and freedom from discrimination and from debt-induced servitude. The second tackles the challenges posed by increased usage of technology in connection with financial services, which tends to solve, but also creates, additional issues for consumers in general, and for vulnerable groups in particular.
