Book Achieving Community Benefits Through Contracts

Download or read book Achieving Community Benefits Through Contracts written by Richard Macfarlane and published by Policy Press. This book was released on 2002 with total page 60 pages. Available in PDF, EPUB and Kindle. Book excerpt: To make employment and training or other community benefits key outcomes of a public expenditure programme, they need to be incorporated into the specification of what is being purchased or funded. The legislative and the policy frameworks for doing this are complex and there has been a lack of detailed guidance, especially in relation to UK policy and legislation, the European Treaty and EC Procurement Directives. In this report the understanding of procurement issues has been furthered by discussions with the Treasury and the Office of Government Commerce. It provides, for the first time, clear guidance on these matters. Specifically, it: - vbTab]details the relevant policy and legal frameworks;- vbTab]sets out procedures that can be used;- vbTab]suggests support that needs to be provided;- vbTab]gives examples of good practice.

Book European Union Non Discrimination Law

Download or read book European Union Non Discrimination Law written by Dagmar Schiek and published by Routledge. This book was released on 2009-06-02 with total page 623 pages. Available in PDF, EPUB and Kindle. Book excerpt: EU equality law is multidimensional in being based on different rationales and concepts. Consequently, the concept of discrimination has become fragmented, with different instruments envisaging different scopes of protection. This raises questions as to the ability of EU law to address the situation of persons excluded on a number of grounds. This edited collection addresses the increasing complexity of European Equality Law from jurisprudential, sociological and political science perspectives. Internationally renowned researchers from Scandinavian, Continental and Central European countries and Britain analyse consequences of multiplying discrimination grounds within EU equality law, considering its multidimensionality and intersectionality. The contributors to the volume theorise the move from formal to substantive equality law and its interrelation to new forms of governance, demonstrating the specific combination of non-discrimination law with welfare state models which reveal the global implications of the European Union. The book will be of interest to academics and policy makers all over the world, in particular to those researching and studying law, political sciences and sociology with an interest in human rights, non discrimination law, contract and employment law or European studies.

Book Privatising Public Prisons

    Book Details:
  • Author : Amy Ludlow
  • Publisher : Bloomsbury Publishing
  • Release : 2015-03-26
  • ISBN : 1782255923
  • Pages : 258 pages

Download or read book Privatising Public Prisons written by Amy Ludlow and published by Bloomsbury Publishing. This book was released on 2015-03-26 with total page 258 pages. Available in PDF, EPUB and Kindle. Book excerpt: Successive UK governments have pursued ambitious programmes of private sector competition in public services that they promise will deliver cheaper, higher quality services, but not at the expense of public sector workers. The public procurement rules (most significantly Directive 2004/18/EC) often provide the legal framework within which the Government must deliver on its promises. This book goes behind the operation of these rules and explores their interaction with the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE); regulations that were intended to offer workers protection when their employer is restructuring his business. The practical effectiveness of both sources of regulation is critiqued from a social protection perspective by reference to empirical findings from a case study of the competitive tendering exercise for management of HMP Birmingham that was held by the National Offender Management Service (NOMS) between 2009 and 2011. Overall, the book challenges the Government's portrayal of competition policies as self-evident sources of improvement for public services. It highlights the damage that can be caused by competitive processes to social capital and the organisational, cultural and employment strengths of public services. Its main conclusions are that prison privatisation processes are driven by procedure rather than aims and outcomes and that the complexity of the public procurement rules, coupled with inadequate commissioning expertise and organisational planning, can result in the production of contracts that lack aspiration and are insufficiently focused upon improvement or social sustainability. In sum, the book casts doubt upon the desirability and suitability of using competition as a policy mechanism to improve public services.

The new edition, while following the broad pattern of previous ones, highlights important new developments in the content of the law, and in its wider social, economic and policy context. Thus the consequences of Brexit are considered along with the emerging effects of the Covid-19 crisis, the increasing digitisation of work, and the implications for policy of debates over the role of the law in constituting and regulating the labour market. The book examines in detail the law governing individual employment relations, with chapters covering the definition of the employment relationship; the sources and regulation of terms and conditions of employment; discipline and termination of employment; and equality of treatment. This is followed by an analysis of the elements of collective labour law, including the forms of collective organisation, freedom of association, employee representation, internal trade union government, and the law relating to industrial action. The seventh edition of Deakin and Morris' Labour Law is an essential text for students of law and of disciplines related to management and industrial relations, for barristers and solicitors working in the field of labour law, and for all those with a serious interest in the subject.

Book Systemic Discrimination in Employment and the Promotion of Ethnic Equality

Download or read book Systemic Discrimination in Employment and the Promotion of Ethnic Equality written by Ronald L. Craig and published by Martinus Nijhoff Publishers. This book was released on 2007 with total page 347 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book argues that traditional complaint-based antidiscrimination laws are inherently inadequate to respond to systemic discrimination in employment. It examines the mechanisms and characteristics of systemic discrimination and the shortcomings of complaint-based laws. Yet these characteristics can also inform employers and government authorities of the kinds of preventive action that help alleviate systemic discrimination at the workplace. In its search for a rational government policy response to systemic discrimination, the book evaluates selected legal regimes which impose proactive obligations on employers to promote equality at the workplace. Proactive regimes are regulatory in nature, rather than adjudicatory. They induce employer compliance through technical assistance, dialogue and regulatory pressure, rather than court orders. By examining the key elements of these regimes the author explains why some proactive regimes function better than others, and why proactive regimes function better than complaint-based laws in addressing systemic discrimination.
