Probably all of as have $2553? Lately read with interest an argument by an eloquent lady to prove the natural equality of the sexes of mankind. I pass by that question entirely. I Will assume, with that lady's opponents, Who, be it observed, are the same class of thinkers that oppose any alteration of the law of property, that men in general are superior to women in general in moral and intel lectual, as they are in muscular, force. Let us say that they have stronger bodies, stronger understandings, and stronger Wills. Should the law then, on this account, throw all its protection round the stronger party at the expense of the weaker? Those who insist most eagerly on the superior strength of men ought to feel most keenly the inequality of the law. It is idle to say that it ought to be left to the stronger to act for the common interests of the two. As long as their interests are really in common no question will arise, whatever the state of the law may be. But it cannot be denied that; in point of fact, the interests of many married couples do, in many cases, diverge. I want to know Why, in such cases, the Whole weight of the law should, so far as regards property, be on the side of the one Who already has enormous practical advantages by reason of his superior strength. The fundamental principle of the new law is that husband and wife are distinct persons, with independent, and possibly conflicting, rights. I have endeavoured to state the old law - shortly, since existing standard works seem to render a fuller statement uncalled for - and to show the altera tions made by the new law, with its varied application according to the date of marriage. The Married Women's Property Act, 1882, has left much to be supplied by judicial interpretation, the burden of which for some time will rest upon the judges of the County Court. I have endeavoured to suggest solutions of some of the many doubts arising upon the construction of this Statute, which will probably be found to be more far-reaching than its authors contemplated, and more radical than a casual perusal of its provisions might suggest. This work, which it was intended should appear with the commencement of the Act, has been delayed by pressure of other matters. Book excerpt: In this first comprehensive study of women's property rights in early America, Marylynn Salmon discusses the effect of formal rules of law on women's lives. By focusing on such areas such as conveyancing, contracts, divorce, separate estates, and widows' provisions, Salmon presents a full picture of women's legal rights from 1750 to 1830. Salmon shows that the law assumes women would remain dependent and subservient after marriage. She documents the legal rights of women prior to the Revolution and traces a gradual but steady extension of the ability of wives to own and control property during the decades following the Revolution. The forces of change in colonial and early national law were various, but Salmon believes ideological considerations were just as important as economic ones. Women did not all fare equally under the law. In this illuminating survey of the jurisdictions of Connecticut, Massachusetts, New York, Pennsylvania, Maryland, Virginia, and South Carolina, Salmon shows regional variations in the law that affected women's autonomous control over property. She demonstrates the importance of understanding the effects of formal law on women' s lives in order to analyze the wider social context of women's experience.
