Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Constitutional Documents of the Puritan Revolution: 1625 1660 The documents in this volume are intended to serve either as a basis for the study of the Constitutional History of an important period, or as a companion to the Political History of the time. By far the greater number of them are printed in books which, though commonly to be found in large libraries, are, on account of their size and expense, not readily accessible to students in general. The MS. of the Constitutional Bill of the first Protectorate Parliament, in the handwriting of John Browne, Clerk of the Parliaments, is preserved at Stanford Hall in the possession of Lord Braye, with whoso kind permission the copy used in this volume has been taken. It is possible that a great part of the document might. have been recovered from the entries of clauses and amendments in tho Journals of the House of Commons, but, as far as I know, this is tho only complete copy in existence. The documents in Part I of the present edition have have been added at the suggestion of Professor Prothero, who very generously placed at my disposal the copies he had made with the intention of adding them to his own Statutes and other Constitutional Documents illustrative of the reigns of Elizabeth and James I (Clarendon Press, 1894). Though the Navigation Act of the Commonwealth has no claim to a place amongst Constitutional Documents, it is of sufficient importance to be printed in tho Appendix. Download or read book The Constitutional Documents of the Puritan Revolution written by Samuel Rawson Gardiner and published by Jazzybee Verlag. This book was released on 2020 with total page 393 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this volume are reprinted for convenient reference more than ninety documents which are "intended to serve either as a basis for the study of the constitutional history of an important period, or as a companion to the political history of the time." With the exception of four, mentioned in the preface, they are taken from books that are beyond the reach of most students unless they have access to large and well-equipped libraries The whole is prefaced by a concise account of the period, so that we have at hand what might be compared to the finder on a telescope. Among the papers are the following, of which we have often heard, and which we can here examine that they may throw light upon our understanding of the history of the period : The Declaration of Sports, the Scottish National Covenant, the Root and Branch Petition, the Solemn League and Covenant, the Self-denying Ordinance.

Book Constitutional Pluralism in the European Union and Beyond

Download or read book Constitutional Pluralism in the European Union and Beyond written by Matej Avbelj and published by Bloomsbury Publishing. This book was released on 2012-02-29 with total page 452 pages. Available in PDF, EPUB and Kindle. Book excerpt: Constitutional pluralism has become immensely popular among scholars who study European integration and issues of global governance. Some of them believe that constitutionalism, traditionally thought to be bound to a nation state, can emerge beyond state borders - most importantly in the process of European integration, but also beyond that, for example, in international regulatory regimes such as the WTO, or international systems of fundamental rights protection, such as the European Convention. At the same time, the idea of constitutional pluralism has not gone unchallenged. Some have questioned its compatibility with the very nature of law and the values which law brings to constitutionalism. The critiques have come from both sides: from those who believe in the 'traditional' European constitutionalism based on a hierarchically superior authority of the European Union as well as from scholars focusing on constitutions of particular states. The book collects contributions taking opposing perspectives on constitutional pluralism - some defending and promoting the concept of constitutional pluralism, some criticising and opposing it. While some authors can be called 'the founding fathers of constitutional pluralism', others are young academics who have recently entered the field. Together they offer fresh perspectives on both theoretical and practical aspects of constitutional pluralism, enriching our existing understanding of the concept in current scholarship.

Book From Vienna to Chicago and Back

Download or read book From Vienna to Chicago and Back written by Gerald Stourzh and published by University of Chicago Press. This book was released on 2010-02-15 with total page 412 pages. Available in PDF, EPUB and Kindle. Book excerpt: Spanning both the history of the modern West and his own five-decade journey as a historian, Gerald Stourzh’s sweeping new essay collection covers the same breadth of topics that has characterized his career—from Benjamin Franklin to Gustav Mahler, from Alexis de Tocqueville to Charles Beard, from the notion of constitution in seventeenth-century England to the concept of neutrality in twentieth-century Austria. This storied career brought him in the 1950s from the University of Vienna to the University of Chicago—of which he draws a brilliant picture—and later took him to Berlin and eventually back to Austria. One of the few prominent scholars equally at home with U.S. history and the history of central Europe, Stourzh has informed these geographically diverse experiences and subjects with the overarching themes of his scholarly achievement: the comparative study of liberal constitutionalism and the struggle for equal rights at the core of Western notions of free government. Composed between 1953 and 2005 and including a new autobiographical essay written especially for this volume, From Vienna to Chicago and Back will delight Stourzh fans, attract new admirers, and make an important contribution to transatlantic history.

Book excerpt: In this wide-ranging study Stephen Foster explores Puritanism in England and America from its roots in the Elizabethan era to the end of the seventeenth century. Focusing on Puritanism as a cultural and political phenomenon as well as a religious movement, Foster addresses parallel developments on both sides of the Atlantic and firmly embeds New England Puritanism within its English context. He provides not only an elaborate critque of current interpretations of Puritan ideology but also an original and insightful portrayal of its dynamism. According to Foster, Puritanism represented a loose and incomplete alliance of progressive Protestants, lay and clerical, aristocratic and humble, who never decided whether they were the vanguard or the remnant. Indeed, in Foster's analysis, changes in New England Puritanism after the first decades of settlement did not indicate secularization and decline but instead were part of a pattern of change, conflict, and accomodation that had begun in England. He views the Puritans' own claims of declension as partisan propositions in an internal controversy as old as the Puritan movement itself. The result of these stresses and adaptations, he argues, was continued vitality in American Puritanism during the second half of the seventeenth century. Foster draws insights from a broad range of souces in England and America, including sermons, diaries, spiritual autobiographies, and colony, town, and court records. Moreover, his presentation of the history of the English and American Puritan movements in tandem brings out the fatal flaws of the former as well as the modest but essential strengths of the latter.
