Book excerpt: As the world economy is liberalized, and national economies become more intertwined, the national decision making of states is also increasingly interdependent, and it has become vital for non-governmental organizations to create an international agenda. This title is an important study of what makes such organizations successful on an international level. The focus is on trade unions, as a key international group of NGOs. It asks whether a global system can be designed to stimulate countries to observe a set of minimum or core standards. It explores three important questions: how have unions attempted to influence the debate on the inclusion of minumum labour standards in the WTO agreement?; what accounts for their success or lack of success?; and what conclusions, with respect to the effective behaviour of trade unions in the construction of international policy, can be drawn from these experiences? In exploring these questions the text looks at social clause debates within a number of international bodies: the ILO, OECD and the EU, and within two countries: the USA and India.

The main conclusion is that trade sanctions to enforce labor standards should not be an option, but that international agreements on core labor standards, with voluntary compliance, may, apart from being worthwhile on ethical grounds, defuse calls for protection.

Book excerpt: This book examines the labour standards provisions in a number of Regional and Bilateral Trade Agreements, and assesses the potential of using the relevant clauses in these trade agreements as a benchmark for a multilateral approach. Based on the lessons learned from the Regional model, the book proposes a Global Labour and Trade Framework Agreement (GLTFA) combined with a joint ILO/WTO enforcement mechanism to resolve the contentious issue of the link between the CLS and international trade. The history of the linkage between the Core Labour Standards (CLS) and international trade dates back roughly 150 years, and has recently become one of the most vexing issues facing policy-makers. At the heart of the debate is the question whether or not trade sanctions should be imposed on countries that do not respect the CLS as embodied in multilateral conventions administered by the International Labour Organization (ILO). Concretely, this would entail inserting a social clause in the World Trade Organization (WTO) rules, and would trigger the imposition of sanctions on those countries that do not adhere to the CLS.

Book excerpt: This study examines the phenomena of “social clauses” that aim to uphold labour standards within the international trade regime and discusses examples of their implementation. “Social clauses”, despite their contentious past within the World Trade Organisation and preceding frameworks, can be found in a number of Free Trade Agreements and Generalised Systems of Preferences. The study initially sets out the history of the link between trade and labour rights and the concerns of various States and academics to the inclusion of “social clauses” in the international trade regime. The study continues to principally examine the content of “social clauses” within Free Trade Agreements concluded by the United States, the European Union, and Canada. Further, the mechanisms for implementing these obligations through various procedures are discussed. Following this, examples of implementation through utilisation of the mechanisms are provided. Additionally, the study also examines similar issues and examples in relation to the Generalised Systems of Preferences of the United States and the European Union. The study finds, in addition to the information relating to content, mechanisms for implementation, and examples of implementation of these social clauses, that although these clauses linking trade and labour proved contentious at an international level, they have been included in a number of subsequent agreements but rarely utilised in practice.
