Book excerpt: Pursuant to a congressional request, GAO reported on the long-range cost to the government and the effects on government employees by the Department of Defense contracting out commercial functions under Office of Management and Budget Circular A-76. GAO found that, of the 20 functions that were contracted out between October 1978 and February 1981, all but one of the functions had subsequent contract cost increases. However, savings were still realized on 17 of the functions. Savings were not realized on two functions and GAO could not determine whether savings were realized on one function. In a review of the effect that 31 contracting-out functions had on government employees, GAO found that of 2,535 employees affected, 74 percent obtained other government positions. Most of the remaining employees resigned, retired, or obtained employment with contractors. Five percent of the employees were separated involuntarily.

Book excerpt: The Office of Management and Budget has recently modified its Circular A-76, which governs the executive policy for the competition of commercial activities. This report provides a brief history of OMB Cir. A-76, a discussion of its place in the legal implementation of the Federal procurement policy, and a review of the main components of the Circular. Important for understanding the Circular is an understanding of the concepts of "commercial activity" and "inherently governmental activity." These two concepts will be emphasized in the discussion. There are several bills pending in the 108th Congress which could affect the implementation of Circular A-76 generally, or as it would apply to a specific Department. These are: H.R. 2691, H.R. 2650 and S. 1363, placing limitations on the Secretary of Interior; H.R. 2658, placing restrictions on the Department of Defense; H.R. 2673, placing restrictions on the Secretary of Agriculture; and H.R. 2989, placing restrictions on the appropriations for the Departments of Transportation and Treasury and independent agencies (OMB is one of these independent agencies).

Book excerpt: Pursuant to a congressional request, GAO reviewed an 8-year Office of Management and Budget (OMB) Circular A-76 cost study at the Marine Corps Air Station in Cherry Point, North Carolina, which concluded in July 1990 that the station's facilities maintenance, utilities, and motor transportation functions could be performed more economically by a contractor. GAO could not clarify whether services could be performed more efficiently by the contractor or whether savings estimates would be realized due to: (1) use of an outdated performance work statement that did not reflect changes in the work requirements; (2) a specification format that did not correspond to the source selection plan format; and (3) the contractor's failure to demonstrate acceptable, specific experience and comprehension in mission-critical work requirements.

Book excerpt: GAO reviewed contract administration at the National Aeronautics and Space Administration's (NASA) Lewis Research Center. GAO found that: (1) the Center contracted out functions for services without comparing the contract costs to in-house performance costs; and (2) NASA does not comply with the Office of Management and and Budget (OMB) Circular A-76, which requires agencies to perform such cost comparisons. NASA officials stated that NASA does not plan to implement such policies because: (1) the quality and experience of NASA managers makes such cost comparisons unnecessary; (2) the preparation of a formal cost comparison is costly and disruptive to ongoing work; (3) the focus on cost would take emphasis away from achieving its primary missions; and (4) the research and development exclusion in the circular relieves NASA from having to perform cost comparisons for such activities. In addition to requiring cost comparisons, the circular provides that: (1) federal agencies periodically review their activities that provide products or services which could be obtained from commercial sources and annually report on their implementation progress; and (2) when personnel ceilings prevent the continuing of lower cost, in-house activities, the agencies should request additional spaces in their annual budget request. GAO found that NASA has neither performed the cost comparisons nor submitted the required annual reports. GAO believes that management decisions of the magnitude discussed should include systematic consideration of cost to ensure that the most cost-effective decisions are reached and, therefore, recommended that NASA implement the policy and procedures of the circular.
