Book excerpt: Before Vatican II, marriage was often considered, or at least popularly expressed, as a union of bodies; that is to say, marriage was an exclusive contract by which a man and a woman mutually handed over their bodies for the purpose of acts which led to the procreation of children. Matrimonial jurisprudence was primarily focused on this marital contract. With the advent of Vatican II and its emphasis on the personalist notion of marriage, a new age dawned whereby canonists, especially auditors of the Roman Rota, were henceforth to view marriage as a union of persons. "Person" is more than a "body"; rather, a person is an individual consisting of wants, needs, desires, impulses, hopes and dreams, whose life experience has been shaped by the milieu "cultural, familial, religious" from which he or she comes. "Union" is not only simply understood as a "contract", but also is now once again recognized as a "covenant", a concept which, at least in the Latin Church, was prevalent until the 12th century. One of the canons of the 1983 CIC, although almost identical in wording to its predecessor in the 1917 CIC, but which now must be understood and interpreted in light of the teachings of Vatican II, is canon 1096 which pertains to the effect of ignorance on matrimonial consent. Given the current appreciation of marriage founded in the teachings of Vatican II, especially in Gaudium et spes, reiterated by Popes Paul VI and John Paul II and described in the Catechism of the Catholic Church, complicated by today's western society's stress on individualism and permeated by a divorce mentality, what is the impact of this canon on matrimonial consent? How can its meaning, once understood as being wider than merely the sexual act itself, be better utilized by those in tribunal ministry? This is the major thrust of the present work. The research of the history and development of the concept of ignorance in canonical writings, how its understanding broadened especially after Vatican II and our conclusions on how to apply its richness to marriage nullity led us to expand the use of this canon: how it can aid in the development of pre-marital preparation programs which would not only possibly help prevent couples from being ignorant of the essence of marriage but also help them to appreciate this richness more deeply in their own lives so that marriage truly can become, as we read in canon 1055, "a partnership of the whole of life which is ordered by its nature to the good of the spouses and the procreation and education of offspring". It is our sincere hope that this study, with its extensive footnotes and up-to-date bibliography will not only be of benefit to all who read it but also will serve as a spring board for further discussion and use of this canon as a ground for nullity and other pastoral uses.

It aimed to answer the main question: What are the possible guidelines for post-matrimonial pastoral care on mixed marriage can be adopted in the Archdiocese of Caceres? Explicitly, it sought to answer the following questions: 1.) How did mixed marriages developed in the course of history, in the context of 1917 Code of Canon Law and Second Vatican Council and what were the attempts for post-matrimonial pastoral care? 2.) What are the norms of mixed marriage in the context of 1983 Code of Canon Law and in canon 1128 on post-matrimonial pastoral care? and 3.) How can the post-matrimonial pastoral care on mixed marriage in the light of canon 1128 be realized in the Archdiocese of Caceres? The study was essentially a qualitative research which employed descriptive and expository analysis method. It was canonical and pastoral in nature. It was a result of library research, analysis and reflection. The canonical provisions regarding mixed marriage in a particular post-matrimonial pastoral care were described and analyzed then based on the collected information, the result was explained and interpreted in order to find out the challenges and the need of the present situation to come up with a proposed program for post-matrimonial pastoral care of mixed marriage in the Archdiocese of Caceres in the light of Canon 1128 of 1983 Code of Canon Law. This study was seen to be of great importance because: 1.) It will guide the local Ordinary in implementing pastoral program on post-matrimonial pastoral care particularly in the Archdiocese of Caceres; 2.) It will provide additional information for the pastors of souls and other involved in family apostolate on how to deal with mixed marriage cases after the celebration of such marriage; 3.) It will enable the local Ordinary, other pastors of souls and other Christian pastoral ministers to know more about their obligations towards the couples and children born out of mixed marriage; 4.) It intends to supplement the current marriage preparation program of the Archdiocese, with regard to the juridical, ecumenical and pastoral care of its members after mixed marriage; and 5.) This work will remind mixed marriage couples regarding the promises they made, and their duty towards the Catholic education of their children; as well as the mutual respect for each other's beliefs, priority of values based on the present situation and their role to share in the life and mission of the Church. A substantial number of sources were gathered through utilization of library materials in the Ecclesiastical Library of University of Santo Tomas. Other related studies were sourced out from the UST Main Library, Graduate Section. Some materials including Church documents, Catholic Bishops Conference of the Philippines documents and Norms for Marriage in the Archdiocese of Caceres were used to formulate and expound the framework of this study. The researcher also used relevant documents, books, commentaries of Canon Law, articles, and some unpublished materials, such as note from the class discussions, homilies, talks and seminars and also electronic materials from on-line sources to enrich the topic and to facilitate the discussion of the subject matter. The study only covered the proposed guidelines for post-matrimonial pastoral care on mixed marriage in the Archdiocese of Caceres in the light of Canon 1128. In order to understand the topic better, the researcher discussed the development of mixed marriage from Scriptures, Traditions and Church’s Magisterium. Certain norms of the 1917 Code of Canon Law were explored to see the development and its attempt for post-matrimonial pastoral care. Some conciliar and post-conciliar documents of the Second Vatican Council and other related norms on mixed marriage and pastoral care in the 1983 Code of Canon Law were also discussed to set the foundation for post-matrimonial pastoral care for such marriage. It was found out that there was indeed a need to address some delicate ecumenical and pastoral issues arising from mixed marriages in the Archdiocese of Caceres. Mixed marriage is an unavoidable reality that needs pastoral attention. The moment we talk about mixed marriage, we are also talking about the issue of Christian unity. The sad division within the family due to differences in beliefs and religious convictions may lead to division within a community, church or society. The Church therefore must be vigilant in this matter. Pastoral assistance must be provided in order to tie up this sad division. Mixed marriage must be seen not as a hindrance but rather as a hope for Christian unity. The church must learn to embrace the past and renew the pastoral practice on mixed marriage in order to respond to the need of time and situation. The Church recognized the difficulties which may result from mixed marriages. However, the Church believes that mixed marriage families have significant and unique contribution particularly to the growth of Christian unity. Mixed marriage families can be the source of inspiration to all Christian families in the promotion of ecumenical family in the context of new evangelization. Mixed marriage families should be involved in all pastoral activity of the Church. They must fulfill its prophetic role by witnessing their faith despite its differences in religious views. In order to realize the potentials of such marriage, the local Church of Caceres should provide post-marriage pastoral activity. Special pastoral concern must be given for such marriage without undermining the sanctity and dignity of marriage. The proposed pastoral guidelines for Post-Matrimonial Pastoral Care can be adopted in the Archdiocese of Caceres to assist mixed marriage couples and their families to live a holier and fuller life and to foster unity of conjugal and family life. The Ecumenical Week of Prayer will serve as the starting point for PMPC. The following guidelines were being offered: EWP is an annual pastoral event of the Archdiocese of Caceres which promotes Christian unity within the family. It should be done in the period between Ascension and Pentecost Sundays to mark the symbolic event of the Church. The opening and closing of EWP will be celebrated within Ecumenical Mass and the guidelines for Eucharistic Hospitality must be observed. The Commission on Sacred Liturgy of the Archdiocese of Caceres should provide Ecumenical Prayers to be recited in all parishes after the post-communion prayer of masses for the entire week. The intention for Christian unity and for conjugal unity of mixed marriage families are to be included in the general intercessions. The content of ecumenical prayer should be based on principles of mutual respect, spirit of inclusivity, balance and diversity, community needs and Holy Scripture. Aside from the public prayer, the whole Christian community is encouraged to offer private prayers intended for Christian unity within the family of mixed marriage couples. The participants for the EWP in the Archdiocese of Caceres includes the following: a.) Mixed marriage couples and their children; b.) Non-Catholic Pastors of the churches or communities not in full communion with the Catholic Church within the territory of the Archdiocese of Caceres; c.) Those who work for the promotion of Christian unity; d.) Mixed marriage couples and other above mentioned from sufragan dioceses may be invited, upon the recommendation of the local Ordinary or other proper authority of the place; and e.) Interreligious marriage couples or disparity of cult may participate in line with canon 1129; however, they must be reminded that EWP is in the Christian context. Other related activities can be initiated provided that it fits the occasion. On-going Ecumenical Enrichment Program on Mixed Marriage, Ecumenical Conferences and Ecumenical Prayer Service must be encouraged and supported by the local ordinary. These will provide mixed marriage couples with the necessary education, awareness, sense of belonging and formation on ecumenical matters. Basically, there are four stages involved in ecumenical education, namely: normative, informative, formative and transformative. After completion of these stages, the Church challenges mixed marriage families to become active agents for pastoral care. They will be called to collaborate in the mission of the Church towards Christian unity. Pastoral monitoring and evaluation must be conducted regularly to determine the progress as well as the need for improvement in the implementation of the pastoral activity. This will ensure that pastoral activities offered by the Church can contribute to the development and spiritual well-being of mixed marriage families in line with canon 1128. It was recommended therefore, that the Archdiocese of Caceres and all the parishes within its territory to form a support group or any ecumenical association who will be in charge of organizing special ecumenical celebrations for mixed marriage families to enrich their commitment and love for family, Church and society.
