Book excerpt: Excerpt from Marriage With a Deceased Wife's Sister Prohibited by the Word of God His sister (lev. Xviii a relative by blood. 4. His half-sister (lev. Xviii. 9, and xx. 17) a relative by blood. 5. His son's daughter (lev. Xviii. A relative by blood. 6. His daughter's daughter (lev. Xviii. A relative by blood. 7. His father's sister (lev. Xviii. 12, and xx, a relative by blood. It seems sufficiently evident that the prohibitions in Lev. 18th include probi bitions of Marriage They were so understood by the Jews, and are so understood by Christians generally. The terms used are not, in themselves, applicable merely to unlawful intercourse between persons not married to each other - they are else where used with reference to marriages. Besides, if there be here no prohibition of incestuous marriages, such marriages are nowhere else forbidden, and thus a Jew might marry his nearest relatives without being guilty of incest. Although inter course with them was punished by death, if there was no marriage, yet if the par ties were married no punishment was infiicted It need scarcely be added that the wife whom a man is forbidden to marry means widow. Two men, father and son, or nephew and uncle cannot be supposed to have been married at the same time to the same wife. It is, obviously, the widow of the father and uncle whom the son and nephew are forbidden to marry. This is a common use of the word wife in other parts of Scripture. Book excerpt: Excerpt from Marriage With a Deceased Wife's Sister: Forbidden by the Laws of God and of the Church Ever Since the passing of the Deceased Wife's Sister's Marriage Act in 1907, followed, as it was, by the calamitous decision of the Dean of Arches in the case of Banister and Wife 72. Thompson,1 I have felt a desire to write something on the matter which forms the subject of this treatise. And this desire was made more intense, when I found that so many members of the Church, for whose judgement in questions of this sort I have been accustomed to feel a very high respect, seemed to be unaware of the seriousness of the divergence from the revealed will of God, which would be brought about, if the Church Should tolerate within her communion such agrant breaches of the Divine law, as would result from any general acquiescence in the principles of the decision of the Court of Arches. For two years after that decision was given I was absent from England, and for most of that time was far removed from all access to good theological libraries, and consequently I had no opportunity for making any adequate preparation for such a discussion of the subject as seemed to be needed. Book excerpt: Excerpt from Review of Several Late Publications on Marriage With a Deceased Wife's Sister: Condemning This Proposed Innovation on Our Religious Institutions If, after all, it be said, that an injunction to a man to marry his brother's widow renders it at least allowable for a woman to marry her late sister's husband, it may be replied, firstly, that the argument itself admits that a permission, and if a permission then a prohibition, may be transferred from one sex to the 0ther - the very ground on which we contend that a prohibition to a woman to marry her husband's brother included a prohib itien to a man to marry his wife's sister; and secondly, that, if this injunction be binding on us, and be not, as we contend, a. Local and national law applicable to the case of the Jews at that time, and to them only, then it must be taken with all its adjuncts also, and it is good for him, and for him alone, who marries his brother's widow, there being no child of such first marriage. We proceed, then, to consider not what in the judgment of any individual may be the Scriptural view of the particular case, but what is the interpretation of Scripture, which, for at least fifteen centuries, has been recognized and affirmed by the Church. The Marriage with a deceased Wife's Sister still my view is, to me, clear and decided. I.
