La obra aborda en un ejercicio que compagina teoría y práctica, una cuestión de rabiosa actualidad y de necesidad indubitada como es la aplicación de los sistemas de IA para apoyar, en sentido afirmativo o negativo, la decisión judicial que adopta la prisión provisional, así como sus efectos para los derechos fundamentales en juego. Con tal fin, la primera parte de la obra se centra en hacer un diagnóstico revelador, un zum, de lo general a lo particular, analizando con un lenguaje atrevido y un estilo directo, cercano en ocasiones al ensayo, el alcance de la revolución digital y sus efectos sobre la Administración de Justicia y el proceso. La segunda parte del trabajo se centra en el análisis de los sistemas expertos de inteligencia artificial judicial de valoración de riesgos (IAJVR) como alternativa a los atávicos heurísticos o atajos intuitivos del juzgador, que hasta la fecha determinan la adopción de medidas cautelares limitativas de derechos, cuyo paradigma es sin lugar a duda la institución de la prisión provisional. Es en este ámbito en el que contar con sistemas de IAJVR puede ayudar a conjurar y objetivar el riesgo real que se pretende enervar con la imposición de tan singular medida. Por último, en la tercera parte el autor focaliza su atención en el empleo de los sistemas de IAJVR en el seno del proceso penal y la afectación que de ello puede derivarse sobre los derechos fundamentales en juego, tales como el derecho de defensa, el derecho al juez imparcial, la presunción de inocencia, la dignidad humana, el derecho a la intimidad, el derecho a la protección de datos o el principio de publicidad procesal, incluyendo propuestas de factis ferenda sobre quién y cómo debe controlar al algoritmo.

In light of recent uprisings around the world against the neoliberal capitalist order, Saul Newman argues that anarchism - or as he calls it postanarchism - forms our contemporary political horizon. In this book, Newman develops an original political theory of postanarchism; a form of anti-authoritarian politics which starts, rather than finishes, with anarchy. He does this by asking four central questions: who are we as subjects; how do we resist; what is our relationship to violence; and, why do we obey? By drawing on a range of heterodox thinkers including La Boétie, Sorel, Benjamin, Stirner and Foucault, the author not only investigates the current conditions for radical political thought and action, but proposes a new form of politics based on what he calls ontological anarchy and the desire for autonomous life. Rather than seeking revolutionary emancipation or political hegemony, we should affirm instead the non-existence of power and the ever-present possibilities of freedom. As the tectonic plates of our time are shifting, revealing the nihilism and emptiness of our political and economic order, postanarchisms disdain for power in all its forms offers us genuine emancipatory potential.
