Book Fundamentals of Legal Argumentation

Download or read book Fundamentals of Legal Argumentation written by Eveline T. Feteris and published by Springer. This book was released on 2017-07-10 with total page 371 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is an updated and revised edition of Fundamentals of Legal Argumentation published in 1999. It discusses new developments that have taken place in the past 15 years in research of legal argumentation, legal justification and legal interpretation, as well as the implications of these new developments for the theory of legal argumentation. Almost every chapter has been revised and updated, and the chapters include discussions of recent studies, major additions on topical issues, new perspectives, and new developments in several theoretical areas. Examples of these additions are discussions of recent developments in such areas as Habermas' theory, MacCormick's theory, Alexy's theory, Artificial Intelligence and law, and the pragma-dialectical theory of legal argumentation. Furthermore it provides an extensive and systematic overview of approaches and studies of legal argumentation in the context of legal justification in various legal systems and countries that have been important for the development of research of legal argumentation. The book contains a discussion of influential theories that conceive the law and legal justification as argumentative activity. From different disciplinary and theoretical angles it addresses such topics as the institutional characteristics of the law and the relation between general standards for moral discussions and legal standards such as the Rule of Law. It discusses patterns of legal justification in the context of different types of problems in the application of the law and it describes rules for rational legal discussions. The combination of the sound basis of the first edition and the discussions of new developments make this new edition an up-to-date and comprehensive survey of the various theoretical influences which have informed the study of legal argumentation. It discusses salient backgrounds to this field as well as major approaches and trends in the contemporary research. It surveys the relevant theoretical factors both from various continental law traditions and common law countries.

Book The Language of Argumentation

Download or read book The Language of Argumentation written by Ronny Boogaart and published by Springer Nature. This book was released on 2021-01-20 with total page 326 pages. Available in PDF, EPUB and Kindle. Book excerpt: Bringing together scholars from a broad range of theoretical perspectives, The Language of Argumentation offers a unique overview of research at the crossroads of linguistics and theories of argumentation. In addition to theoretical and methodological reflections by leading scholars in their fields, the book contains studies of the relationship between language and argumentation from two different viewpoints. While some chapters take a specific argumentative move as their point of departure and investigate the ways in which it is linguistically manifested in discourse, other chapters start off from a linguistic construction, trying to determine its argumentative function and rhetorical potential. The Language of Argumentation documents the currently prominent research on stylistic aspects of argumentation and illustrates how the study of argumentation benefits from insights from linguistic models, ranging from theoretical pragmatics, politeness theory and metaphor studies to models of discourse coherence and construction grammar.

The pragma-dialectical quantitative approach to empirical research on argumentative discourse is illustrated by reporting on selected, illustrative experimental studies, as well as qualitative studies of historical cases.

Available in PDF, EPUB and Kindle. Book excerpt: The purpose of this book is to explain that the art of advocacy and persuasion, when tied to the “ many convincing proofs” (Acts 1:3) of the factual resurrection of Jesus Christ, is deeply Biblical and is best seen as “ logic supplemented” and not “ logic supplanted.” With examples, both good and bad, from our profession, the reader will learn how to “ think like a lawyer” when engaged in “ giving a reason for the hope that is within” them.We have all heard it said of someone: “ He thinks like a lawyer.” In spite of the generally negative public image of lawyers in our day, this characterization is usually a high compliment: It suggests clarity and precision of thought, coupled with a particular persuasive ability not shared by those outside the legal profession. In this book, we shall examine the reasoning process in general, together with those special styles of reasoning and presentation that lawyers and judges employ professionally to get to the truth in the best of cases. This book combines the “ is” and the “ ought” : we wish to offer a clear description of legal reasoning and also provide some normative guidelines to assist in the improvement of your reasoning faculties.

Book Examining Argumentation in Context

Download or read book Examining Argumentation in Context written by Frans H. van Eemeren and published by John Benjamins Publishing. This book was released on 2009 with total page 317 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Examining Argumentation in Context: Fifteen studies on strategic maneuvering "contains a selection of papers on strategic maneuvering in argumentative discourse. Starting point of all of these contributions is that a satisfactory analysis and evaluation of strategic maneuvering is possible only if the argumentative discourse is first situated in the communicative and interactional context in which it occurs. While some of the contributions present general views with regard to strategic maneuvering, other contributions report on the results of empirical studies, examine strategic maneuvering in a particular legal or political context, or highlight the presentational design of strategic maneuvering. "Examining Argumentation in Context" therefore provides an insightful" "view of recent developments in the research on strategic maneuvering, which is currently prominent in the study of argumentation.

Book DiaLaw

    Book Details:
  • Author : A.R. Lodder
  • Publisher : Springer Science & Business Media

Download or read book DiaLaw written by A.R. Lodder and published by Springer Science & Business Media. This book was released on 2013-12-01 with total page 207 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is a revised version of my dissertation 'DiaLaw - on legal th justification and dialog games' that I defended on June 5 1998 at the Universiteit Maastricht. The chapters 1, 4 & 5 (now: 1, 5 & 6) of my dissertation have remained largely unaltered. In chapter 2 I added explicitly the distinction between constructing legal justification and reconstructing it, and tried to elucidate the differences (and similarities) between the product and process of justification. Chapter 3 is divided into two chapters: one on the general characteristics of DiaLaw (now: chapter 3), and the other on specific, legal characteristics of DiaLaw (now: chapter 4). In order to improve readability, all rules in these chapters have been rewritten considerably. The section on the implementation of DiaLaw is moved to the appendix. In chapter 7 (the former chapter 6), a discussion of the notions 'procedural' and 'structural' arguments is added, and different layers in argumentation models are discussed. Finally, in chapter 8 (the former chapter 7) is added a recapitulation of my view on legal justification, and a discussion on the future use in legal practice of dialog models that represent argumentation in a natural way. The main thesis has remained unaltered: legal justification should be modeled as a procedural, dialogical model in which not only products of argumentation are allowed, but, even in formal models, rhetorical, psychological aspects of argument are dealt with.
