Due to the increase of divorce rates in the past decades researchers have changed their perspective and have concentrated on the view of divorce as a personal experience that is greatly affected by the socials and economic environment. The aim of this thesis is to investigate divorce that has become a mass phenomenon in our present society. The assumption is that in order to understand the grounds for divorce and its consequences, we have to view divorce as a phenomenon that occurs at the intersection of personal, socio-economic and legal factors. Family disputes involve persons who have interdependent and continued relati- ships and arise in a context of distressing emotions. Separation and divorce affect all the members of the family, especially children. The study presents a comprehensive analysis of divorce as a psychological process that is situated within a social and a legal context. It presents a comprehensive view of divorce as a psychosocial, economic and legal phenomenon and contains a review of the research literature about divorce and its consequences for parents and children. Moreover, it describes divorce by proposing conceptual frames and explanatory models.

The editors invited a group of international experts to explain the approaches taken in their jurisdictions to allegations of domestic violence in child contact cases, with a view to identifying international best practices in such cases. The book includes contributions from England and Wales, Scotland, Ireland, Canada, Sweden and Spain, as well as information presented at the symposium from New Zealand and Australia. The chapters include attention to particular issues such as specialist domestic violence courts, judicial training and hearing children’s voices. Collectively, the chapters identify a set of common problems experienced across all of the jurisdictions, including an overwhelming emphasis on the value of children’s ongoing contact with non-resident parents and the consequent minimisation of domestic violence and the muting of the voices of children who do not wish to have contact with abusive parents. Best practices in taking domestic violence seriously and providing adequate protection from further abuse for children and non-abusive parents were less in evidence. However, the concluding chapter draws together details of several initiatives and approaches which offer promising ways forward. The chapters in this book were originally published as a special issue of the Journal of Social Welfare and Family Law.

An important critical assumption made by the authors is that the gender equality perspective has been largely neglected in several branches of private law, since scholars researching the intersection between gender and legal studies are mostly focused on public law and human rights law. In light of that, the book contributes not only to the deconstruction of gender-blind private law, but also to the development of a gender-competent analysis of the key branches of private law, starting with private international law. Gender perspective in family law is analyzed on the basis of gendered and heteronormative operations of family law with reference to the formation of legally recognized relationships, the establishment of legal parenthood, the division of marital property after a divorce, and the arrangements for post-separation parenting. Also, regulation of family matters in Indian society and the gender equality perspective from the principle of the child’s best interest are considered. As far as tort law is concerned, the book addresses compensation for damages suffered by women performing unpaid household work. Further, it contains papers dedicated to the following labour law issues: the genesis of labor law and its capacity to contribute either to worsening gender inequality in the world of work or to promoting gender equality; gender segregation in the labour market and its connection to family-friendly policies in the European Union; sexual harassment at work; and the impact of work digitalization on gender-related labour law issues. Lastly, the authors analyze gender equality in civil procedural law, as well as in mediation as a tool for encouraging the peaceful settlement of disputes. Book excerpt: La guarda y custodia compartida es una medida de carácter familiar que, en la actualidad, tras la Reforma del Código Civil en el año 2005, se configura como una alternativa, una opción, frente al régimen de visitas tradicional, una vez que los progenitores han obtenido sentencia judicial de separación o divorcio. Si bien esta medida ha sido vista, siempre, con recelos por la doctrina española y, también, por nuestra jurisprudencia, hay que resaltar que se trata de una medida que favorece un sistema igualitario de comunicación de los progenitores con sus hijos menores de edad, siendo ello favorable para el desarrollo y la formación integral de la personalidad psicoafectiva de éstos. En el pasado reciente, esta medida fue vista con recelos, aunque tiene indudables ventajas y beneficios tanto para los progenitores como para los hijos. En la presente monografía se aborda la problemática que genera la actual regulación de la guarda y custodia compartida, abogando la autora, Abogada especializada en Derecho de familia y profesora de la Escuela de Práctica Jurídica de Jerez de la Frontera, por su instauración, al estimar que esta medida viene a paliar, en muchas ocasiones, los efectos indeseables y perjudiciales del tradicional régimen de visitas. La autora se muestra partidaria, abiertamente, de esta medida, siempre que las condiciones de ambos progenitores —laborales, profesionales, geográficas, etc.— la permitan, al argumentar que el contacto de ambos progenitores es el marco ideal para que los hijos se desarrollen sin traumas. No cabe duda que la medida familiar de guarda y custodia compartida ofrece unos beneficios evidentes, al permitir que ambos progenitores participen, en idéntica forma, en la vida de sus hijos menores de edad, aportando así un principio de igualdad —y de no discriminación— en los papales y roles familiares. La presencia, permanente, cariñosa y afectiva, de ambos progenitores en el desenvolvimiento de la formación y educación de los hijos es un pilar fundamental para que éstos crezcan en libertad y al calor del afecto y protección de sus progenitores. La custodia compartida posibilita, a juicio de la autora, que ambos padres asuman sus obligaciones parentales en un plano de igualdad, sin que haya de prevalecer, necesariamente, la intervención de la madres sobre la del padre, y sin tener que recurrir al régimen de visitas que, tal como la experiencia forense demuestra, no satisface íntegramente las exigencias de un adecuado desarrollo a nivel afectivo y emocional de los hijos.
