Book excerpt: "The provisions of the Workplace Relations Amendment (Right of Entry) Bill 2004 fulfil the Government's commitment to further the cause of industrial relations reform, as outlined in its 2004 election policy statement Flexibility and Productivity in the Workplace: The Key to Jobs. There are two main elements to the bill: provisions reforming the union right of entry laws to ensure balance to their operational effect; and provisions excluding the operation of state right of entry laws where Commonwealth law also applies. In the case of the second element, this can be achieved through the use of the corporations power in the Constitution, provided that employers are registered corporations." -- p. 1.

Book Whatever Happened to Frank and Fearless

Download or read book Whatever Happened to Frank and Fearless written by Kathy MacDermott and published by ANU E Press. This book was released on 2008-07-01 with total page 176 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this evidence-based and closely argued work, Kathy MacDermott plots the changes in the culture of the Australian Public Service that have led many contemporary commentators to lament the purported loss of traditional public service values of impartiality, intellectual rigour and - most importantly - the willingness of public servants at all levels to offer frank and fearless advice to their superiors and their ministers. MacDermott brings to her analysis an insider's sensibility and a thorough forensic analysis of the impact of some 20 years of relentless administrative 'reform' on the values and behaviour of the APS. Although this story has its beginnings in the Hawke-Keating eras, MacDermott convincingly argues that structural and cultural change compromising the integrity of the public service reached its apogee towards the end of the eleven years of the Howard government. This is a 'must read' for students of Australian political and administrative history. MacDermott offers cautionary observations that the new national government might do well to heed.

As well as providing a comprehensive guide to employment relations in Australia, the text also offers a selective international comparative view on the management of the employment relationship. The text explains and emphasises the real-world connections between the important theories of industrial relations and human resources, which are key components of the employment relations discipline. The overarching aim is for students to gain a deeper understanding of the 'World of Work', through the discipline of Employment Relations.

Book excerpt: This edited collection is the culmination of a comparative project on 'Voices at Work' funded by the Leverhulme Trust 2010 - 2013. The book aims to shed light on the problematic concept of worker 'voice' by tracking its evolution and its complex interactions with various forms of law. Contributors to the volume identify the scope for continuity of legal approaches to voice and the potential for change in a sample of industrialised English speaking common law countries, namely Australia, Canada, New Zealand, UK, and USA. These countries, facing broadly similar regulatory dilemmas, have often sought to borrow and adapt certain legal mechanisms from one another. The variance in the outcomes of any attempts at 'borrowing' seems to demonstrate that, despite apparent membership of a 'common law' family, there are significant differences between industrial systems and constitutional traditions, thereby casting doubt on the notion that there are definitive legal solutions which can be applied through transplantation. Instead, it seems worth studying the diverse possibilities for worker voice offered in divergent contexts, not only through traditional forms of labour law, but also such disciplines as competition law, human rights law, international law and public law. In this way, the comparative study highlights a rich multiplicity of institutions and locations of worker voice, configured in a variety of ways across the English-speaking common law world. This book comprises contributions from many leading scholars of labour law, politics and industrial relations drawn from across the jurisdictions, and is therefore an exceedingly comprehensive comparative study. It is addressed to academics, policymakers, legal practitioners, legislative drafters, trade unions and interest groups alike. Additionally, while offering a critique of existing laws, this book proposes alternative legal tools to promote engagement with a multitude of 'voices' at work and therefore foster the effective deployment of law in industrial relations.

Book Introduction to Employment Relations

Download or read book Introduction to Employment Relations written by R Loudon and published by Pearson Higher Education AU. This book was released on 2015-05-20 with total page 333 pages. Available in PDF, EPUB and Kindle. Book excerpt: The second edition of Introduction to Employment Relations takes a broad-based approach to the subject of workplace relations in Australia. Employment relations encompasses all aspects of people at work whereas, historically, industrial relations (IR) and human resource management (HRM) have focused on distinct aspects. The focus of IR is on collective approaches to employment, while for HRM, the emphasis is on more individual approaches. In keeping with its broad-based approach, the book covers the organisation of work, unions and employer associations, awards and agreements, staffing and development, managing performance and rewards, in addition to identifying and explaining the major changes in employment relations in recent years. This book is suitable for introductory courses at undergraduate and postgraduate levels.
