Book excerpt: Using the contemporary workings of property law in India through the lives and thoughts of middle-class and poor women, this is a study of the ways in which cultural practices, and particularly notions of gender ideology, guide the workings of law. It urges a close reading of decisions by women that appear to be contrary to material interests and that reinforce patriarchal ideologies. Hailed as a radical moment for gender equality, the Hindu Succession Act was passed in India in 1956 theoretically giving Hindu women the right to equal inheritance of their parents' self-acquired property. However, in the years since the act's existence, its provisions have scarcely been utilized. Using interview data drawn from middle-class and poor neighborhoods in Delhi, this book explores the complexity of women's decisions with regard to family property in this context. The book shows that it is not passivity, ignorance of the law, naiveté about wealth, or unthinking adherence to gender prescriptions that guides women's decisions, but rather an intricate negotiation of kinship and an optimization of socioeconomic and emotional needs. An examination of recent legal cases also reveals that the formal legal realm can be hospitable to women's rights-based claims, but judgments are still coded in terms of customary provisions despite legal criteria to the contrary.

The accounts of the innumerable courageous women workers who have taken steps – individually and collectively – to bring about change at the personal and community levels speak of the struggles, the sense of solidarity and the triumph they experience as they build their homes with their own hands; bargain with government and private agencies for access to water, sanitation, affordable energy and land rights; find solutions to make their homes climate-resilient; and participate in city-level planning and decision-making processes. Together, the success stories of Meena, Mumtaz, Parul, and others like them, reflect the central message of the MHT’s mission: that women living in urban informal settlements must be taken along if India wishes to make its cities participatory, inclusive and sustainable.

Yet we know little about their capacity to upend entrenched social, political, and economic hierarchies. Women, Power, and Property explores this question within the context of India, the world's largest democracy. Brulé employs a research design that maximizes causal inference alongside extensive field research to explain the relationship between political representation, backlash, and economic empowerment. Her findings show that women in government – gatekeepers – catalyze access to fundamental economic rights to property. Women in politics have the power to support constituent rights at critical junctures, such as marriage negotiations, when they can strike integrative solutions to intrahousehold bargaining. Yet there is a paradox: quotas are essential for enforcement of rights, but they generate backlash against women who gain rights without bargaining leverage. In this groundbreaking study, Brulé shows how well-designed quotas can operate as a crucial tool to foster equality and benefit the women they are meant to empower.

Book excerpt: While I was aware of some of the social, political and cultural underpinnings of women's inferior position in land relations and in society at large in South Asia, my research grew out of a desire to gain a more nuanced understanding of issues relating to Indian women's access to and authority over urban land and landed property. [...] While the residents of only one slum had access to formal land titles through a Government of Gujarat land distribution program, others considered quasi-legal and informal factors like the length of occupation, the size of a settlement, political patronage, the level and cohesion of community organization, support from civil society organizations, or possession of documents like ration cards and e [...] They mentioned the ability of political leaders to secure multiple stay orders on eviction notices and the eventual willingness of the municipal corporation to include the slums in the upgradation project as evidence of their security of tenure. [...] It can also mean that the position of women in landed property ownership is not necessarily an outcome of the desire to subjugate women but may well be a consequence of competition between different groups of men or of the inability of certain groups of men to acquire control over landed property. [...] But women's ability to improve their position in the intrahousehold arena has been impeded by a history of entrenching inequality in the construction of gender, in the entitlement to property and in public decision-making.

In some cases, life-cycle markers such as marriage, divorce and widowhood are critical, and in many cases, it is the organisation of the household, residential patterns and kinship rights which are seen to structure the relationships of women, men and property. Ideological constructs regarding female sexuality, and also those in which women and children may be conceptualised as 'objects' are considered in detail. Surprisingly, little attention has been paid to the significance of property as a critical factor affecting the position of women in society, and the original papers presented here provide new dimensions for a neglected area of feminist debate. This book will be of interest to students of sociology, political science, law and gender studies.

It focuses on India, examining the legislative processes that led to the 2005 amendment of the Hindu Succession Act 1956, along with several interconnected welfare policies. Scholars have understood these Acts as a response to growing concerns about women’s property rights in developing countries. In re-reading these Acts and exploring the wider nexus of Indian society in which the legislation was drafted, this study considers how questions of family structure and property rights contribute to the creation of legal subjects and demonstrates the significance of the politico-economic context of rights formulation. On the basis of an ethnography of a village in West Bengal, this book brings the moral axis of inheritance into sharp focus, elucidating the interwoven dynamics of bequest, distribution of family wealth and reciprocity of care work that are integral to the logic of inheritance. It explains why inheritance rights based on the notion of individual property rights are inadequate to account for practices of inheritance. Mondal shows that inheritance includes normative structures of affective attachment and expectations, i.e., evaluatively-charged imaginaries of the future that coordinate present practices. These insights pose questions of the dominant resource-based conceptualisation of inherited property in the debate on women’s empowerment. In doing so, this work opens up a line of investigation that brings feminist rights discourse into conversation with ethics, enriching the liberal theory of gender justice.

Notions such as this have, in their own way and over time, given the women in the Santal Parganas the resolve to wrest what is rightfully theirs. This is a powerful book in the way in which it unfolds the lives and anxieties of Santal women in two villages of Dumka district, Jharkhand. From the very inception, adivasi women come alive through separate life histories. They span different situations and social patterns but all of them relate to rights in landed property, and their own troubled identities in the backdrop of harsh living conditions, social discrimination and lack of state support. Land for the Santal women is not a mere economic resource. It stands for security, social position and identity, and in this men have a distinct advantage. Soon after, writing in a personal vein, the author unfolds how these anxieties of the Santal women resonate her own. The author traces the relationship between Santals and their land from historic times to the modern era when they have access to both the modern legal system and their own customary laws. She also examines the role of external agencies in this struggle - government administrative bodies, non-governmental organizations and political leaders. As modern influences crowd out traditional mores the author asserts that development is not always a benign process of social advancement but a highly political struggle for re-negotiating power relations between men and women, and among social groups. The use of a 'community' identity as adivasis has also been responsible for denying women rights to land in the context of the movement for political autonomy of Jharkhand. Based on rich ethnographic material, this sensitive book lays bare the reality of being an adivasi and an adivasi woman, in all its nuances, in the modern globalized world.
