  • Author : Louis-Georges Schwartz
  • Publisher : Oxford University Press
  • Release : 2009-09-24
  • ISBN : 0199718032
  • Pages : 141 pages

Download or read book Mechanical Witness written by Louis-Georges Schwartz and published by Oxford University Press. This book was released on 2009-09-24 with total page 141 pages. Available in PDF, EPUB and Kindle. Book excerpt: Mechanical Witness is the first cultural and legal history charting the changing role and theoretical implications of film and video use as courtroom evidence. Schwartz moves from the earliest employment of film in the courts of the 1920s to the notious 1991 Rodney Kind video, revealing how the courts have developed a reliance on film and video technologies and contributed to the growing influence of visual media as a dominant mode of knowledge formation. At the same time, film and video in juridical contexts has developed a distinct theoretical legacy. The particular qualities of film as evidence both resonate with and contradict existing scholarship-focusing on economic, social, or aesthetic factors-which hitherto has defined film's status and cultural contribution. In the context of a trial, the possible meanings of a film change from its meanings when shown in a movie theater or broadcast on television, yet the public (and cinema scholars) tend to assume that the two are the same. Mechanical Witness demonstrates that we must understand evidentiary film and video's institutional specificity if we are to understand the full effects of motion picture technologies on our culture. This study sets the terms for a long overdue assessment of how the entertainment industry has shaped our film viewing practices, the place of moving picture evidence in the courtroom, and the social and cultural consequences of these intertwined histories.

Book Trial Technique and Evidence

    Book Details:
  • Author : Michael R. Fontham
  • Publisher : Aspen Publishing
  • Release : 2013-06-28
  • ISBN : 1601562454
  • Pages : 892 pages

Download or read book Trial Technique and Evidence written by Michael R. Fontham and published by Aspen Publishing. This book was released on 2013-06-28 with total page 892 pages. Available in PDF, EPUB and Kindle. Book excerpt: Evidence and Trial Advocacy are often taught as if in practice; the topics are not related. The original edition of this title pioneered the concept that instruction on trial technique and evidence rules in the same volume is an effective way to teach either an evidence or trial advocacy course. This combination provides students with the foundation for becoming skilled trial advocates within the boundaries of the rules of evidence. Trial Technique and Evidence explains the purpose and application of each evidence rule. The practical methods of presenting evidence are balanced against the requirements of the rules. Indeed, many evidence rules are "practice" rules, either not covered in the formal rules of evidence or not addressed in detail. The basis for introducing demonstrative exhibits, for example, is not included in the federal rules, and impeaching witnesses in trial requires knowledge of practical technique. Trial Technique and Evidence allows a professor to incorporate practical requirements with evidence theory. The text also includes practical steps for compliance with the rules, with examples to facilitate the student's understanding, and addresses recent developments such as: • Jury persuasion • Application of rules to electronic evidence • Trends in applying the Daubert factors for assessing expert testimony • Amendments to the Federal Rules of Evidence

Download or read book Electronic Technology and Civil Procedure written by Miklós Kengyel and published by Springer Science & Business Media. This book was released on 2012-06-26 with total page 332 pages. Available in PDF, EPUB and Kindle. Book excerpt: The effect of modern and communication technology on civil procedure first appeared on the agenda of the conference organized by the International Association of Procedural Law in 1999, verifying Lord Woolf’s statement from the 90’s, that ”IT will not only assist in streamlining and improving our existing systems and process; it is also likely, in due course, itself to be catalyst for radical change as well...”. At the conference in Pecs in the autumn of 2010 participants from three continents and twenty-five countries examined all aspects of the impact of modern information technology on civil procedure beginning with the electronic submission of the application, ranging from electronic service of documents and electronic means of proof supported by modern information technology. In addition to the practical issues they discussed the possible impact of electronic procedures on traditional principles of civil procedure. The conference book contains seven main reports and eleven correferates, the foreword was written by Prof. Peter Gottwald, the President of the International Association of Procedural Law.
