Le 9 août 2010, la France adopté une loi destinée à adapter le système français aux prévisions du Statut de Rome. Toutefois, la définition du crime de génocide n'a pas été modifiée par cette loi. Or, le droit international diffère du droit français sur la question du génocide. En droit international, la prohibition du génocide est destinée à assurer la protection de groupes humains stables et permanents et est fondée sur l'intention de détruire, en tout ou partie, un groupe, comme tel. Par contraste, en droit français, la prohibition du génocide est destinée à protéger l'humanité de l'homme et est défini par référence à un plan concerté tendant à la destruction, en tout ou partie d'un groupe. Il est ici suggéré" d'introduire en droit français la protection des groupes humains à travers l'interdit du génocide tout en maintenant une référence à un programme préconçu de destruction dans la définition du crime.

For 60 years, the crime of genocide has been recognised as the most horrendous crime in international law, famously designated the 'crime of crimes'. On the occasion of the 60th anniversary of its adoption the UN High Commissioner for Human Rights stated that 'genocide is the ultimate form of discrimination'. In the same context the chief prosecutor of the International Criminal Court described the Genocide Convention as a 'visionary and founding text for the Court'. The Convention has as such influenced the subsequent development of many different areas of international law. For example, the 1951 Advisory Opinion on the Genocide Convention enabled the International Court of Justice to shape the modern regime of reservations to treaties. More recently, the prohibition against genocide has become a crucial pillar of the regime of international criminal law developing since the 1990s, with genocide being one of the core crimes falling under the jurisdiction of the UN ad hoc tribunals, the Extraordinary Chambers in the Courts of Cambodia and the permanent International Criminal Court.In this work the 19 provisions of the Convention are analysed article-by-article, with abundant references to state practice and case law.

Ce futur paraissant tout aussi effrayant que fascinant pose de nombreuses questions. En effet, l’Homme ne cesse de s’inventer des méthodes toujours plus destructrices, des méthodes toujours plus avancées, des méthodes toujours plus sournoises pour provoquer la mort. Or, en découvrant que certains auteurs ont eu, et ont parfois toujours, de funestes impacts sur une population, cela m’a laissé penser que la communauté juridique n’était pas dotée d’outils pour les juger. Le criminel apprend de ces prédécesseurs. Des nombreux génocidaires ont déjà été jugés sur la base de la convention de 1948 relative au génocide. Sous ces enseignements de la justice internationale, des individus développent ou peuvent développer des pratiques qui auraient pour finalité dissimulée un génocide. La communauté internationale commence à être coutumière de la gestion judiciaire des génocides classiques, mais elle n’envisage pas le futur, les émulations du génocide, ces descendants qui ont la même finalité et qui pourtant sont mieux dissimulés dans leurs intentions. Certains Etats, comme la Russie ou le Vietnam, ont entamé des innovations juridiques comme le processus de reconnaissance de nouveaux crimes internationaux graves en s’inspirant du concept de génocide, que ce soit consciemment ou inconsciemment. Faire de l’innovation juridique, c’est avant tout réaliser un travail proche de la divination, anticiper des comportements qui n’auront peut-être jamais lieu. Cependant, ce processus est nécessaire au nom du principe de prévention, car quoi de plus essentiel que d’alerter la communauté juridique sur des risques futurs contre la vie humaine, avant même que celle-ci ne soit en danger ?

Book excerpt: Résultat d’un travail de comparaison entre le droit de la Cour pénale internationale et le droit français sur le crime de génocide, l’analyse est construite autour de deux axes : le premier est relatif aux fondements de l’incrimination du génocide, le second au champ de la répression du génocide, la thèse visant ainsi à la détermination d’un concept juridique idéal de génocide. L’étude des fondements de l’incrimination, d’abord, révèle que la prohibition du génocide ne peut être envisagée qu’en référence à un souci de protection des minorités contre une entreprise de destruction de ces groupes prenant la forme d’un projet collectif. Si le droit international, dans une optique collectiviste, place la protection des minorités au coeur de la valeur protégée par l’interdit du génocide, le Statut de Rome ne fait pas du projet collectif de destruction un élément nécessaire au crime de génocide, mais maintient l’exigence d’une intention individuelle de détruire, en tout ou partie, un tel groupe. A l’inverse, le droit français érige la notion de plan concerté en composante de l’infraction de génocide, mais n’envisage pas l’interdit du génocide comme un instrument de préservation des minorités, concevant celui-ci, dans une optique exclusivement individualiste, comme un moyen de protection de l’humanité de l’homme. Il est donc proposé de réaliser une sorte de fusion des deux systèmes. L’étude du champ de la répression, ensuite, conduit à préconiser, comme élément moral de l’infraction de génocide, la volonté chez l’accusé d’inscrire son comportement dans l’exécution du projet collectif de destruction d’un groupe. Il est également suggéré d’unir l’ensemble des infractions liées au crime principal de génocide (incitation au génocide, entente génocidaire) en subordonnant la constitution de ces infractions à l’existence d’un projet collectif de destruction d’un groupe minoritaire et à l’existence d’une volonté chez l’accusé de s’en faire l’agent, à l’image de l’infraction principale de génocide.
