Book excerpt: Examining in detail the International Convention on the Elimination of All Forms of Racial Discrimination, the Convention on the Elimination of All Forms of Discrimination Against Women, and the International Covenant on Civil and Political Rights, this book studies and critiques the methods employed by the United Nations in adopting instruments to protect human rights. Pointing to many examples of unclear provisions and of overlap and conflict within a single instrument or between instruments, Meron concludes that the present system of law-making is inadequate and suggests some reforms both of the institutions and of the process itself.

Book The Human Rights Covenants at 50

Download or read book The Human Rights Covenants at 50 written by Daniel Moeckli and published by Oxford University Press. This book was released on 2018-06-07 with total page 400 pages. Available in PDF, EPUB and Kindle. Book excerpt: Half a century ago, on 16 December 1966, the UN General Assembly adopted the International Covenant on Civil and Political Rights (ICCPR) and the International Covenant on Economic, Social and Cultural Rights (ICESCR). While the adoption of the two UN human rights covenants was celebrated all over the world, their 50th anniversary has received very little attention from the international community. The present book marks this anniversary by taking stock of the first half-century of the existence of what are probably the world's two most important human rights treaties. It does so by reflecting on what the covenants have achieved (or failed to achieve) in the years that have passed, by determining and comparing their current influence in the various regions of the world, and by assessing their potential roles in the future. The book contains papers that were presented during a symposium held in Zurich in 2016, which brought together experts and stakeholders from a range of disciplines and world regions. Some fundamental issues that are addressed by the contributors are as old as the two covenants themselves. They concern, for example, the division of human rights into first- and second-generation rights, and the question of whether there should be one central monitoring body - possibly a world court - or more than just one. However, the contributors go beyond such questions that have been explored before; they develop new answers to old questions and point to new challenges.

Book The International Covenant on Civil and Political Rights and Its first Optional Protocol

Download or read book The International Covenant on Civil and Political Rights and Its first Optional Protocol written by Johann Bair and published by . This book was released on 2005 with total page 226 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Human Rights Committee has, in its many years of existence, developed an extensive jurisprudence made up of concluding observations prepared in response to state reports, general comments on the interpretation of the International Covenant on Civil and Political Rights (ICCPR) and views expressed in individual cases submitted under the First Optional Protocol. The ICCPR as a human rights treaty confers rights on individuals. Individuals are not only the bearers of these rights but also the ones who, filing their complaints to the Human Rights Committee, enable the committee to clarify the meaning of these rights. This book unites all elements of the jurisprudence of the Human Rights Committee. The views concerning individuals in concrete situations form the core of this book.

Book The Universal Declaration of Human Rights

Download or read book The Universal Declaration of Human Rights written by William A. Schabas and published by Cambridge University Press. This book was released on 2013-04-18 with total page 4171 pages. Available in PDF, EPUB and Kindle. Book excerpt: A collection of United Nations documents associated with the drafting of the Universal Declaration of Human Rights, these volumes facilitate research into the scope of, meaning of and intent behind the instrument's provisions. It permits an examination of the various drafts of what became the thirty articles of the Declaration, including one of the earliest documents – a compilation of human rights provisions from national constitutions, organised thematically. The documents are organised chronologically and thorough thematic indexing facilitates research into the origins of specific rights and norms. It is also annotated in order to provide information relating to names, places, events and concepts that might have been familiar in the late 1940s but are today more obscure.
