How do you know a sodomite when you see one? In Seeing Sodomy in the Middle Ages, Robert Mills explores the relationship between sodomy and motifs of vision and visibility in medieval culture, on the one hand, and those categories we today call gender and sexuality, on the other. Challenging the view that ideas about sexual and gender dissidence were too confused to congeal into a coherent form in the Middle Ages, Mills demonstrates that sodomy had a rich, multimedia presence in the period—and that a flexible approach to questions of terminology sheds new light on the many forms this presence took. Lawyers had been producing reports of trials and appellate proceedings in order to understand the law and practices of the Westminster courts since the Middle Ages, and printed reports had appeared in the late fifteenth century. This book considers trials in the regular English criminal courts in the eighteenth and nineteenth centuries. It also considers the contribution of criminal lawyers in developing the modern rules of evidence. The book explores the influence of scientific and pseudoscientific knowledge on Victorian insanity trials and trials for homosexual offences, respectively. The British Trials Collection contains the only readily accessible and near-verbatim accounts of civil trials from the 1760s, 1770s, and 1780s, decades crucial to understanding how the rules of evidence developed. It might be thought that Defence of the Realm Acts (DORA) or its regulations would have introduced trials in camera. The book presents a comparative critique of war crimes trials before the International Military Tribunals at Nuremberg and Tokyo and the International Tribunals for the former Yugoslavia and for Rwanda. The first spy trial by court martial after the legal change in 1915 was that of Robert Rosenthal, who was German. The book also considers the principal features of the first war crimes trial of the twenty-first century in terms of personnel and procedures, the alleged crimes, and issues of legality and legitimacy. It also speculates on the narratives or non-narratives of the trial and how these may impact on the professed aims and objectives of the litigation.

Book excerpt: Despite the increasing popularity of queer scholarship, no major work in English thus far has explored the evidence of male homosexual behaviour found in the inquisitorial court records of early modern Spain. This absence seems all the more glaring considering the wealth of available archival material. Sexual Hierarchies, Public Status aims to fill this gap by comprehensively examining the Aragonese Inquisition's sodomy trials. Using court records, Cristian Berco provides an analysis of male sexuality and its connection to public social structures and processes. His study illustrates how male homosexual behaviour existed within a widespread gendered system that extolled the penetrative act as the masculine pursuit of an emasculated passive partner. This sexual hierarchy based on masculinity constantly intersected in a potentially subversive manner with notions of public hierarchy and posed a threat to local sexual economies. Yet, Berco demonstrates how the views of private denouncers and magistrates in the sodomy trials produced divergent sexual economies that rendered persecution unstable and diffuse. By focusing on how hierarchies were created both within sexual relationships and in the public eye, this investigation traces the significance of homosexual desire in the context of daily social relations informed by status, ethnic, religious, and national differences.

Book excerpt: Having arriving in the Province of Maine in 1641 with a brief to create both government and law for the fledgling colony, Thomas Gorges later recorded his policy as having ’steared as neere as we could to the course of Ingland’. Over the course of the next century the various colonial administrations all consciously measured their laws against that of England, whether their intention was imitation of or conscious opposition to, established English legal system. In order to trace the shifting and contested relationships between colonial laws and English laws, this book focuses on the prosecution of sexual misconduct. All crimes can threaten orderly society but no other crime posed quite the same long term implications as illicit sex resulting in the birth of illegitimate children who became their own social challenges. Sexual misconduct was, consequently, a major concern for early modern leaders, making it a particularly fruitful subject for studying the complex relationship between laws in England and laws in the English colonies. Political and ecclesiastical leaders create laws to coerce people to behave in a certain fashion and to convey wider messages about the societies they govern. When those same laws are broken, lawbreakers must be tried and punished by a means intended to serve as a warning to other would-be lawbreakers. In this book the two-part analysis of changing sexual misconduct laws and the resulting trial depositions highlights the ways in which ordinary New England colonists across New England both interacted with and responded to the growing Anglicization of their legal systems and makes the argument that these men and women saw themselves as taking part in a much larger process.
