Book excerpt: All in all, this Commentary finds that the Fiscal Compact signed on 2 March 2012 by all member states of the EU (except the UK and the Czech Republic) may be long on good intentions but is rather short on substance. The main danger is that it has been oversold and in no way constitutes a first step towards fiscal or political union. It is likely that the ratification process (e.g. the referendum in Ireland) and then the implementation process in some difficult countries (e.g. France) will receive a lot of attention and create a distorted impression of the importance of the Fiscal Compact. Once the initial excitement is over, however and national fiscal rules have been put in place, this Treaty will quietly be forgotten.--Publisher description.

Book excerpt: The Treaty on Stability, Coordination and Governance in the Economic and Monetary Union is an intergovernmental Treaty signed by 25 Member States (all except the Czech Republic, Croatia and the United Kingdom) in 2012. It complements the EU fiscal framework, such as the Stability and Growth Pact. The proposal integrates the substance of the Treaty on Stability, Coordination and Governance into EU law. This foresees that a balanced budget rule in structural terms should be applied, along with a correction mechanism in case of significant deviation. As reported by the Commission in February 2017, relevant provisions have already been enacted into national laws. The proposal takes into account the appropriate flexibility built into the Stability and Growth Pact and identified by the Commission since January 2015. The provisions are fully in line with existing rules defined in primary and secondary legislation. The initiative is presented in the form of a proposal for a Council Directive under Article 126(14)(2) of the Treaty on the Functioning of the European Union.

Book excerpt: The European Scrutiny Committee's report (HCP 1817, ISBN 9780215043665) on the Treaty on Stability, Coordination and Governance (SCG), states that it is impossible to enforce and there are serious concerns over the rule of law, with no concessions for the UK. The Committee also views the SCG Treaty as doing little towards solving the eurozone crisis, except providing some comfort to international markets. It is also possible that the Treaty will prove to be politically impossible to enforce. Some form of breakdown of the eurozone clearly remains possible. The approach taken to proceed with the fiscal compact raises a fundamental question about the application of the rule of law within the EU. The SCG Treaty would have been an EU treaty but for the veto. However, the EU institutions and the governments of the 25 Member States who have signed the Treaty, have embarked on a dangerous precedent in seeking to attain their political objectives irrespective of the rule of law in the EU. The Government has made clear that it has serious reservations about the legality of what has been done, but the question of what it intends to do remains unsatisfactorily unresolved. When looking at the unprecedented letter sent from Sir John Cunliffe, the UK Ambassador to the EU, to the Secretary-General of the Council on 22 February, it appears that the Government does not want to stand in the way of 25 States reinforcing the eurozone, but sees the use of the institutions outside the EU Treaties, without the consent of all 27 Member States, as unlawful, irrespective of the consequences to and the lack of concessions for the United Kingdom and the current failure to take the issue of legality further. To the Committee it therefore seems that the SCG Treaty must be deemed unlawful in the Government's view. Although questions have been raised as to what the UK achieved by the use of its veto, the Committee concludes that the veto was justified because of the very real concerns about a breach of EU law, even if this was not the reason given exclusively for the use of the veto in the first place. The Committee notes that there is an increasing tendency for the EU to propound the virtues of the rule of law but not to apply it in practice.

The Treaty introduced new rules in the Euro Zone and into the EU as a whole. Establishing strict requirements for budget deficit, it calls for strong fiscal discipline and for real fiscal austerity in many EU member states, which makes this Treaty one of the biggest challenges for the EU in its sixty-two years of history. From now on the budgets of the EU states will have to follow very specific fiscal objectives and criteria. The Treaty is a legally binding act that sets new pillars for building a new economic and political profile of the EU. Moreover, it will influence the countries, which have not signed the Treaty yet, such as the United Kingdom and the Czech Republic, as well as the candidate states. This paper tries to put more light on the prospects of the Fiscal Compact and the related measures and on their impact on the economic, legal and the political future of the Union. It focuses on the implementation challenges of the Treaty and the new measures that aim for stronger cohesion within the Euro zone and further afield.

Its fiscal provisions have been further developed by subsequent primary and secondary legislation -in particular, the Stability and Growth Pact with its preventive and corrective arms, and the Treaty on Stability, Coordination and Governance in EMU. These instruments together constitute the fiscal framework of the European Union. In early 2020, the European Commission launched a review of the EU's economic governance, seeking in particular to establish how effective the surveillance provisions have been in achieving their objectives. This paper aims to provide an introduction to the Union's economic governance, starting from a brief overview of the economic literature, and concluding with a look at possible developments that might follow from the review, not least examining the various calls for its amendment that have been put on the table. While the Commission's review has been put to one side while the immediate issues of the coronavirus pandemic are addressed, the economic consequences of the pandemic are themselves changing the context for the review.
