Book excerpt: Enacted in 1975, the Education for All Handicapped Children Act – now called the Individuals with Disabilities Education Act (IDEA) provides all children with the right to a free and appropriate public education. On the face of it, the IDEA is a shining example of law’s democratizing impulse. But is that really the case? In Disabled Education, Ruth Colker digs deep beneath the IDEA’s surface and reveals that the IDEA contains flaws that were evident at the time of its enactment that limit its effectiveness for poor and minority children. Both an expert in disability law and the mother of a child with a hearing impairment, Colker learned first-hand of the Act’s limitations when she embarked on a legal battle to persuade her son’s school to accommodate his impairment. Colker was able to devote the considerable resources of a middle-class lawyer to her struggle and ultimately won, but she knew that the IDEA would not have benefitted her son without her time-consuming and costly legal intervention. Her experience led her to investigate other cases, which confirmed her suspicions that the IDEA best serves those with the resources to advocate strongly for their children. The IDEA also works only as well as the rest of the system does: struggling schools that serve primarily poor students of color rarely have the funds to provide appropriate special education and related services to their students with disabilities. Through a close examination of the historical evolution of the IDEA, the actual experiences of children who fought for their education in court, and social science literature on the meaning of “learning disability,” Colker reveals the IDEA’s shortcomings, but also suggests ways in which resources might be allocated more evenly along class lines.

Book 108th United States Congress

Download or read book 108th United States Congress written by Monet Dejesus and published by . This book was released on 2012-05-08 with total page 36 pages. Available in PDF, EPUB and Kindle. Book excerpt: What's so special about Individuals With Disabilities Education Act?In this new, compelling book from author Monet Dejesus, find out more about Individuals With Disabilities Education Act ...The Individuals with Disabilities Education Act is a United States federal law that governs how states and public agencies provide early intervention, special education, and related services to children with disabilities. It addresses the educational needs of children with disabilities from birth to age 18 or 21 in cases that involve 14 specified categories of disability. The IDEA is "spending clause" legislation, meaning that it only applies to those States and their local educational agencies that accept federal funding under the IDEA. While States declining such funding are not subject to the IDEA, all States have accepted funding under this statute and are subject to it.The IDEA and its predecessor statute, the Education for All Handicapped Children Act, arose from federal case law holding the deprivation of free public education to disabled children constitutes a deprivation of due process. It has grown in scope and form over the years. IDEA has been reauthorized and amended a number of times, most recently in December 2004, which contained several significant amendments. Its terms are further defined by regulations of the United States Department of Education, which are found in Parts 300 and 301 of Title 34 of the Code of Federal Regulations. In defining the purpose of special education, IDEA 2004 clarifies Congress??? intended outcome for each child with a disability: students must be provided a Free Appropriate Public Education that prepares them for further education, employment and independent living.Under IDEA 2004:.So, what seperates this book from the rest?A comprehensive narrative of Individuals With Disabilities Education Act, this book gives a full understanding of the subject.A brief guide of subject areas covered in "108th United States Congress - Individuals With Disabilities Education Act" include -- Individuals with Disabilities Education Act- Individualized Education Program- Free Appropriate Public Education (FAPE)- Least Restrictive EnvironmentFind out more of this subject, it's intricacies and it's nuances.
