Download or read book Uncivil Disobedience written by Jennet Kirkpatrick and published by Princeton University Press. This book was released on 2008-09-02 with total page 152 pages. Available in PDF, EPUB and Kindle. Book excerpt: Uncivil Disobedience examines the roles violence and terrorism have played in the exercise of democratic ideals in America. Jennet Kirkpatrick explores how crowds, rallying behind the principle of popular sovereignty and desiring to make law conform to justice, can disdain law and engage in violence. She exposes the hazards of democracy that arise when citizens seek to control government directly, and demonstrates the importance of laws and institutions as limitations on the will of the people. Kirkpatrick looks at some of the most explosive instances of uncivil disobedience in American history: the contemporary militia movement, Southern lynch mobs, frontier vigilantism, and militant abolitionism. She argues that the groups behind these violent episodes are often motivated by admirable democratic ideas of popular power and autonomy. Kirkpatrick shows how, in this respect, they are not so unlike the much-admired adherents of nonviolent civil disobedience, yet she reveals how those who engage in violent disobedience use these admirable democratic principles as a justification for terrorism and killing. She uses a "bottom-up" analysis of events to explain how this transformation takes place, paying close attention to what members of these groups do and how they think about the relationship between citizens and the law. Uncivil Disobedience calls for a new vision of liberal democracy where the rule of the people and the rule of law are recognized as fundamental ideals, and where neither is triumphant or transcendent.

Book The Politics of the U S Cabinet

Download or read book The Politics of the U S Cabinet written by Jeffrey E. Cohen and published by University of Pittsburgh Pre. This book was released on 2010-11-23 with total page 221 pages. Available in PDF, EPUB and Kindle. Book excerpt: Jeffrey E. Cohen presents a detailed, quantitative study of the characteristics of presidential cabinets from the days of George Washington through the first Reagan administration. Dividing U.S. history into five party eras, he examines cabinet members' age, education, region, occupation, recruitment patterns, party affiliations, and relations with other branches and institutions of government. This study also addresses major theoretical issues: the Constitution never provided for a cabinet, although George Washington established it. Questions soon arose as to its functions, relation to Congress, and the rules and precedents guiding its activities. Cohen examines how the cabinet balanced representation and capability, and how, despite a lack of institutional authority, it has managed to survive through every administration.

Book Disobeying the Security Council

Download or read book Disobeying the Security Council written by Antonios Tzanakopoulos and published by OUP Oxford. This book was released on 2013-02-14 with total page 276 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines how the United Nations Security Council, in exercising its power to impose binding non-forcible measures ('sanctions') under Article 41 of the UN Charter, may violate international law. The Council may overstep limits on its power imposed by the UN Charter itself and by general international law, including human rights guarentees. Such acts may engage the international responsibility of the United Nations, the organization of which the Security Council is an organ. Disobeying the Security Council discusses how and by whom the responsibility of the UN for unlawful Security Council sanctions can be determined; in other words, how the UN can be held to account for Security Council excesses. The central thesis of this work is that states can respond to unlawful sanctions imposed by the Security Council, in a decentralized manner, by disobeying the Security Council's command. In international law, this disobedience can be justified as constituting a countermeasure to the Security Council's unlawful act. Recent practice of states, both in the form of executive acts and court decisions, demonstrates an increasing tendency to disobey sanctions that are perceived as unlawful. After discussing other possible qualifications of disobedience under international law, the book concludes that this practice can (and should) be qualified as a countermeasure.
