On the one hand, the Internet provides valuable new opportunities for overcoming geographic limitations and the promise of unprecedented open access to public information for research on a global basis. On the other hand, there are growing restrictions on the availability and use of public data and information arising from the privatization and commercialization of such sources. This countervailing trend undermines the traditional scientific cooperative and sharing ethos. It diminishes the public domain and open access to such global public goods and leads to a host of lost opportunity costs at both the national and international levels. To address these issues the International Council for Science (ICSU), the United Nations Educational, Scientific and Cultural Organization (UNESCO), the U.S. National Academies, the Committee on Data for Science and Technology (CODATA), and the International Council for Scientific and Technical Information (ICSTI) jointly organized this symposium, which was held on March 10-11, 2003, at UNESCO headquarters in Paris. Book excerpt: This book explores the emerging economic reality of health data pools from the perspective of European Union policy and law. The contractual sharing of health data for research purposes is giving rise to a free movement of research data, which is strongly encouraged at European policy level within the Digital Single Market Strategy. However, it has also a strong impact on data subjects' fundamental right to data protection and smaller businesses and research entities ability to carry out research and compete in innovation markets. Accordingly the work questions under which conditions health data sharing is lawful under European data protection and competition law. For these purposes, the work addresses the following sub-questions: i) which is the emerging innovation paradigm in digital health research?; ii) how are health data pools addressed at European policy level?; iii) do European data protection and competition law promote health data-driven innovation objectives, and how?; iv) which are the limits posed by the two frameworks to the free pooling of health data? The underlying assumption of the work is that both branches of European Union law are key regulatory tools for the creation of a common European health data space as envisaged in the Commissions 2020 European strategy for data. It thus demonstrates that both European data protection law, as defined under the General Data Protection Regulation, and European competition law and policy set research enabling regimes regarding health data, provided specific normative conditions are met. From a further perspective, both regulatory frameworks place external limits to the freedom to share (or not share) research valuable data.

The Computer Science and Telecommunications Board was asked to organize one of these forums, a public forum to gather the views of a variety of government and private sector stakeholders about the impact of spectrum policy on their activities. This report presents a summary of those views. Among those included are those representing national defense, homeland security, aviation, science, public safety, amateur radio, cellular voice and data, and terrestrial broadcast uses of the spectrum. Although prepared by the NRC, the report does not present NRC findings or recommendations. A broader study of spectrum policy, including findings and recommendations, will be issued in early 2005.

Book excerpt: New legal approaches, such as the European Union's 1996 Directive on the Legal Protection of Databases, and other legal initiatives now being considered in the United States at the federal and state level, are threatening to compromise public access to scientific and technical data available through computerized databases. Lawmakers are struggling to strike an appropriate balance between the rights of database rights holders, who are concerned about possible commercial misappropriation of their products, and public-interest users of the data such as researchers, educators, and libraries. A Question of Balance examines this balancing act. The committee concludes that because database rights holders already enjoy significant legal, technical, and market-based protections, the need for statutory protection has not been sufficiently substantiated. Nevertheless, although the committee opposes the creation of any strong new protective measures, it recognizes that some additional limits against wholesale misappropriation of databases may be necessary. In particular, a new, properly scoped and focused U.S. statute might provide a reasonable alternative to the European Union's highly protectionistic database directive. Such legislation could then serve as a legal model for an international treaty in this area. The book recommends a number of guiding principles for such possible legislation, as well as related policy actions for the administration.
