IP includes inventions, works of art, and written products. A host of protections, including copyright, trade secret, patent, and trademark, support the defense of creators' rights and facilitate the distribution of the creations into the broader world. Researchers assessed IP support at the U.S. Department of Homeland Security (DHS) and its components and found that IP initiatives offer greater opportunities for operational improvement than DHS currently recognizes. The research revealed several IP issues that expose programs to substantial risk. The authors believe that the current funding and organization of IP activities do not serve DHS's long-term interests and that DHS should manage IP as an element clearly connected to organizational success. Enforcing IP laws involves many U.S. agencies, making coordination essential. Under the Prioritizing Resources and Organization for Intellectual Property Act of 2008 (PRO-IP Act), Congress required the U.S. Attorney General, through the Department of Justice (DoJ), to devote additional resources and undertake other specific IP efforts. The PRO-IP Act also created the position of the Intellectual Property Enforcement Coordinator (IPEC) to enhance interagency coordination. This report addresses DoJ and IPEC¿s efforts to implement the act. It also compares the 2010 Joint Strategic Plan on Intellectual Property Enforcement to the content called for in the PRO-IP Act. The Department of Homeland Security's Customs and Border Protection (CBP) leads intellectual property (IP) enforcement activity at the U.S. border. GAO was asked to (1) examine key aspects of CBP's process to carry out border enforcement, (2) analyze CBP's border enforcement outcomes during fiscal years 2001 to 2006, and (3) evaluate CBP's approach for improving border enforcement. GAO examined relevant documents, interviewed agency officials in Washington, D.C. and seven port locations, and analyzed CBP data on trade and IP seizure and penalty activity. This is the public version of a law enforcement sensitive report by the same title (GAO-07-350SU).
