(4) Irregularities invalidating the whole election. Matters not of themselves sufficient to avoid an election are alleged at the petitioner's risk as to costs (The Staleybridye Case, 19 L. T. N. S. 660). IV. What A Petition Must Contain. (1) A petition must state the right of the petitioner to petition within 31 & 32 Vict. e. 125, s. 5 (v. supra, p. 208); and (2) The holding and result of the election and (briefly) the facts and grounds relied on to sustain the prayer (General Eules (England), r. 2). Note.--These rules are of the same force as if they were enacted in the body of the Act of 1868 (31 & 32 Vict. c. 125, s. 25). The rules passed by the Scots and Irish judges under the Act are almost identical with those framed by the English judges. Where there is any difference, it is pointed out in the following pages as far as they go. (3) It must conclude with a prayer, and he signed by the petitioner or petitioners (General Eules (England r. 4; 31 & 32 Vict. c. 125, s. 6). Note.--A petition must also be divided into paragraphs, confined as nearly as may be to distinct portions of the subject, and these paragraphs must be numbered (General Rules (England), r. 3).
