Book excerpt: Excerpt from The North American Review, Vol. 8 Sir William Jones, in a letter to Lord Althorpe, written after one of those excursions to France, in which his inquisitive mind, grasping every species of intellectual attainment, combined the severer studies of political science and law with the luxury of oriental literature, states that he had, among his various pursuits, attended some causes at the Palais, and brought home with him the works of a most learned lawyer, whose name and merit he should have the honour of making known to his countrymen. This writer was Pothier, whom he afterwards noticed and imitated in his beautiful essay on the Law of Bailments, and of whose treatises on the different species of contracts he speaks in the following enthusiastic manner: 'I seize with pleasure an opportunity of recommending those treatises to the English lawyer, exhorting him to read them again and again; for if his great master, Littleton, has given him, as it must be presumed, a taste for luminous method, apposite examples, and a clear manly style, in which nothing is redundant, nothing deficient, he will surely be delighted with works in which all those advantages are combined, and the greatest portion of which is law at Westminster as well as at Orleans. Such a One presented himself, or rather was recommended to us, in Pierre Beatte, a half-breed of French and Osage parentage. We were assured that he was acquainted with all parts of the coun try, having traversed it in all directions, both in hunting and war parties; that he would be of use both as guide and interpreter, and that he was a first rate hunter. I confess I did not like his looks when he was first presented to me. He was lounging about, in an old hunting frock and metasses or leggins, of deer skin, soiled and greased, and almost japanned by constant use. He was apparently about thirty-six years of age, square and strongly built. His features were not bad, being shaped not unlike those of Napoleon, but sharpened up, with high Indian cheek bones. Perhaps the dusky greenish hue of his complexion, aided his resemblance to an old bronze bust I had seen of the Emperor. He had, however, a sullen. It certainly is so, if we adopt the popular impression. Romance, Poetry, and Rhetoric point, on the one hand, to the august conception of a one all-ruling deity, a Great Spirit, omniscient and omnipresent, and we are told to admire the untutored intellect which could conceive a thought too vast for Socrates and Plato. On the other hand, we find a chaos of degrading, ridiculous, and incoherent superstitions. A closer examination will show that the contradiction is more apparent than real. We will begin with the lowest forms of Indian belief, and thence trace it upward to the highest conceptions which the unassisted mind of the savage attained. To the Indian, the material world is sentient and intelligent. Birds, beasts, and reptiles have ears for human prayers, and are endowed with influence on human destiny. A mysterious and inexplicable power resides in inanimate things. They, too, can listen to the voice of man, and influence his life for evil or for good. Lakes, rivers, and waterfalls are sometimes the dwelling-place of spirits, but more frequently they are themselves living beings, to be propitiated by prayers and offerings.
