Book excerpt: Excerpt from An Argument Against the Constitutional Validity of the Legal Tender Clause, Contained in the Act of Congress of Feb, 25, 1862, Authorizing the Issue of Treasury Notes It further appears that the plaintiff, having become the owner of the mortgaged premises, on the eleventh day of June, 1869, tendered to the defendant as payment of the debt and interest, in Treasury Notes of the United States, issued under the Act of Congress passed February 95, 1869, and claimed there for a discharge of the mortgage. The defendant refused to receive these notes as payment of the debt, but subsequently received them under an agreement that his right to exact pay. Ment in gold should be submitted to this Court, upon a case stated under a provision of the Code. That this was a contract payable in gold, or its equivalent, there can be no question. When the debt was contracted there was no lawful money of the United States but gold and sil ver. When the debt became due, August 28d, 1857 It was due in gold or silver money of the United States. The defend ant's right under the mortgage then became perfect 5 it was a right to foreclose and sell for the payment of the mortgage debt measured by the current coin Of the United States. It is now claimed, however, that an Act of Congress, passed more than four years after the debt was thus due and payable in coin, and after the defendant's right of foreclosure and sale for coin had become perfect, enables the plaintiff to discharge the lien of this mortgage by tendering Treasury Notes, which were at 4 per cent. Discount below the value of coin at the time of thetender, and are now vastly lower. The case, therefore, presents the naked question of the power of Congress thus to affect the value of a debt which was due and payable in Specie more than four years before the Act was passed; which debt was due from one citizen of this State to another citizen of this State, and was secured by a mortgage upon real property situated within the same State. Book excerpt: Excerpt from United States Notes: A History of the Various Issues of Paper Money by the Government of the United States At the date of the adoption of the Constitution, the issue of paper money in any form was popularly re garded with aversion. The experience of the colonists with bills of credit, as paper money was then called, had been fraught with loss and political disturbance, and the experience with the like issues by the Contin ental Congress had so affected the minds of the wisest and best men of that time, that in the Federal Conven tion the general feeling was one of almost bitter opposi tion to granting the power to emit bills of credit to the new Government. N 0 one can examine the records of those days without being thoroughly impressed that the sense of the Convention was in favor of an absolute prohibition. Further proof may be found in the fact that from 1791 to 1812, a period of twenty-one years, the method of raising funds for the Government by the issue of bills of credit was not even suggested nor indeed were circulating notes, in form payable on demand without interest, issued at all, until more than seventy years after the adoption of the Constitution. The charter of the first Bank of the United States expired in 1811, and the Federalists were not strong enough to secure a recharter. When the war of 1812broke out, the necessity of funds was so imperative, that the Administration and Congress felt themselves forced, the one to recommend, and the other to author ize, the issue of interest-bearing Treasury notes. They were regarded as a measure of necessity. Loans in the ordinary form had failed, and these notes were regarded as a convenient form of loan. They were not intended to circulate as money; they were fundable into public stock, and, as a matter of fact, were retired as soon as possible after the close of the war. These issues were, however, a fatal precedent out of which has grown a latitude of constitutional construction not then antici pated. I have been encouraged to write them by the rapidly growing movement in favour of bimetallism and by assurance of aid from coming events, which may give the whole community lessons far sharper than our cotton workers, agriculturists and oriental traders have already received. Material prosperity has been retarded for 20 years and in many quarters there is deep depression, which has. Now reached a point requiring either a reduction of wages or a closure of business. Even the bankers and money lenders, among whom are the chief opponents of bimetallism, should consider the danger of such a general struggle between labour and capital. The banking interest is indeed itself in danger with no more than 25 or 30 millions of gold available to meet depositors' claims of 900 millions payable on demand. As yet only the weak spots of finance and banking, such as the Baring firm and Australian banks, have been touched, but we may be approaching a time when poor people will prefer gold to bank notes and consider an old stocking or a friend's cash boxa safer place for their savings than a bank, which pays no interest and perhaps may pay no principal. These dangers are not of my imagining. They have been discussed by able financiers, such as Mr. Goschen and Mr. H. Hucks Gibbs, in whom deep study has combined with practice an understanding of things which the practical man merely handles. Many even pf the practical men are taking alarm, as shown by the attempt of London bankers to get together a reserve of gold independent of the Bank of England. If I have strong opinions on this question they are not the result of my connection with India, which has now ceased, nor is this pamphlet much more than a compilation of current literature.
