The basic problem was always that the conditions in world agricultural markets were distorted by the national agricultural policies followed by all developed countries - policies which national authorities were reluctant to adapt to conform with the requirements of a liberal international trading system for agricultural products. This book describes and analyses the attempts that were made to make trade in agriculture less distorted, more stable and predictable, and less of a dangerous source of political friction between nations, in successive rounds of negotiations under the General Agreement on Tariffs and Trade in the 45-year period from GATT's inception in 1947 to the end of the Uruguay Round in 1993. While the book analyses the development of international trade policy throughout the post-war period, particular attention is given to the Kennedy, Tokyo and Uruguay Rounds of GATT negotiations in which the problems of trade in agricultural products were confronted.

Whatever the motivation for trade-related legal reform, our experience in the FAO Legal Office has been that besides the substantial costs involved, there are many challenges to successful and meaningful legal and institutional reforms. Legal drafters must therefore be well aware of the existing legal and administrative culture. They must also have a realistic appreciation of the resource constraints in the country, for inadequate resources certainly restrict the ability of implementing bodies to put new rules into practice. This study is about the nature and extent of these trade-related legal and institutional reforms with a particular focus on those of direct relevance to the agricultural sector. In addition to the sectoral focus on agriculture, the study places distinct emphasis on the challenges of developing countries in the implementation of trade-related international obligations in the agricultural sector. It derives from FAO's experience in advising countries on the implementation of agriculture-related WTO agreements, key elements of which are discussed and illustrated by three representative case studies.

However, as Chen argues here, another significant factor has been overlooked. The current food insecurity is not absolute food shortage, since global food production still exceeds the need of the entire world population, but a problem of how to secure access to resources. Distorted agricultural trade undermines world food distribution, and uneven distribution impedes people’s access to food, particularly in poor developing countries. Examining EU and US agricultural policies and World Trade Organization negotiations in agriculture, the author argues how they affect the international agricultural trade, claiming that current food insecurity is the result of inequitable food distribution and trade practices. Book excerpt: The challenges to meeting the growing global food demand—population and income growth and supply uncertainties complicated by climate change, environmental pressures, and water scarcity—all point to the increasing importance of trade and the need for a more, not less, open trading system. Growth in agricultural trade has been facilitated in part through the rules-based system established under the World Trade Organization (WTO), particularly the Uruguay Round Agreement on Agriculture (AoA). The AoA was implemented in 1995 and brought substantial discipline to the areas of market access, domestic support, and export competition. However, progress since the Uruguay Round has been limited. While the Doha Development Agenda (DDA) was launched with much anticipation in 2001, members failed to reach agreement in July 2008 and the trade agenda in Geneva has since advanced slowly. Despite the best efforts of many, the negotiating intensity seen in late 2007 and 2008 has largely dissipated, in part due to the global recession and the inevitable changes in governments that sometime shift the focus of negotiations. Serious efforts were made to renew the negotiations, but in the end, members have had to be content with harvesting the low-hanging fruit, such as trade facilitation and export competition. Although there have been significant accomplishments, they represent but a small portion of what was on the table during the DDA negotiations. In addition, negotiated settlements on the tougher issues, such as market access and domestic support, have become more difficult to obtain in isolation. The recent experience at the WTO’s Eleventh Ministerial Conference in Buenos Aires highlights the difficulties of reaching a negotiated settlement on domestic support in isolation from, say, market access. Given the increasing importance of trade in addressing food security needs and its critical role in efforts to eliminate malnutrition and hunger by 2030, achieving further progress in the liberalization of world trade is of paramount importance.
