Book Tenancy Legislation in Malabar 1880 1970

Download or read book Tenancy Legislation in Malabar 1880 1970 written by V. V. Kunhi Krishnan and published by Northern Book Centre. This book was released on 1993 with total page 212 pages. Available in PDF, EPUB and Kindle. Book excerpt: In agrarian societies land is the most important means of wealth and source of power and prestige. Rights in land are often hereditary with power and prestige. Therefore, changes in the tenurial system and the pattern of ownership will have far reaching effects on the social order. The Indian peasantry appeared as a formidable force against foreign domination after the imposition of British authority. Investigates the impact of British rule in the agrarian relations of Malabar district, in the Madras presidency which came under the direct rule of the British in 1792 and the consequent complexities in landlord tenant relations. The various tenancy legislations and later land reforms in the State of Kerala are also studied. The relations of the Peasant movement with the nationalist movement and the role of the Malabar peasantry in the anti-imperialist, anti-landlord struggles are discussed at length.

Book The Restrictive Covenant in the Control of Land Use

Download or read book The Restrictive Covenant in the Control of Land Use written by Donald L. Sabey and published by Routledge. This book was released on 2019-05-23 with total page 198 pages. Available in PDF, EPUB and Kindle. Book excerpt: First published in 1999, this book breaks new ground by treating the restrictive covenant from the aspect of the control of land use. At its heart is a detailed account of the discharge or modification mechanism, a system of practical importance to professionals in law, planning and land management. This central component is furthered by an historical account of the development of the concept from Tulk v Moxhay (the seminal case of 1848) to the present and by an assessment of its future in a legal system dominated by planning and environmental control. It is a study of the way in which a particular equitable doctrine has grown from simple beginnings to become a tool of considerable practical importance, enabling it to meet changing social and economic needs. It charts the growth of a concept, wherein principles of private and public law come together in the fields of property and planning and gives some pointers to possible reform of the law and the future role of the restrictive covenant.

Book The Law of Compulsory Purchase and Compensation

Download or read book The Law of Compulsory Purchase and Compensation written by Michael Barnes KC and published by Bloomsbury Publishing. This book was released on 2014-12-01 with total page 786 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is a statement of the current law of compulsory purchase of land and compensation for that purchase. It covers all major aspects of the procedure for the compulsory acquisition of land and deals in full detail with all aspects of the law of compensation for such an acquisition. The many and diverse statutory provisions are organised into a series of chapters containing all principles and rules and there is a full analysis and explanation of the leading authorities on the subject and the principles derived from those authorities without which the subject cannot be understood. The aim of the book is, not only to explain the statutory provisions and to organise the various possible claims for compensation into different heads, but also to explain and analyse the substantial body of case law which has built up, particularly in recent years, and the relationship between that body of law and the underlying statutory provisions. The book also attempts to explain the purpose of the statutory provisions and the reason for the rules that are derived from the authorities. Chapters of the book are devoted to the procedure for formulating and pursuing a claim for compensation and to the valuation principles which must be applied in advancing claims. An Appendix is provided by Mr Nicholas Eden FRICS, a leading valuer in the field, which contains examples of different types of compensation valuation with annotations as to how the valuations are prepared and built up. A further aim of the book is to provide, where possible, practical advice to public authorities and landowners involved in the process of compulsory purchase and compensation as well as to explain the legal principles.
