Book excerpt: This contributed volume examines the trend whereby the EU resorts ever more often to informal arrangements and deals with third countries in an effort to curb and manage migration flows towards the EU and facilitate the return of irregular migrants to their countries of origin or transit. The perceived success of the EU-Turkey deal provided a strong impetus for the continuation of this trend. The contributions collected and presented in this book aim to shed light on the implications of this trend for the EU constitutional order, the human rights of those affected by these deals, the third countries with which the EU cooperates, and the global refugee protection regime. They demonstrate how these deals raise more issues than they solve; by, for instance, sidestepping established Treaty rules and procedures, violating the human rights of those affected, and overburdening the nascent migration and asylum systems of third country partners. This book, the first volume to appear in the Global Europe Series, will be of great interest to researchers and policy makers working in the field of migration and asylum. They often work under conditions of vulnerability, on temporary contracts and with few rights. This dissertation examines collective actions aiming to improve the precarious conditions of three categories of workers –discriminated, seasonal and undocumented. The collective actors examined in the dissertation are composed of formal organisations such as non-governmental organisations, organisations founded on ethnic grounds and trade unions, but also more temporary groups and networks. The analysis foregrounds contemporary societal, economical and legal transfigurations that create the conditions for collaboration among the actors and the negotiations which they conduct. The dissertation contains four articles. The first article, addressing the situation of discriminated migrant workers, scrutinises the conditions for the engagement of anti-discrimination agencies. The result of the study illustrates how the actors, as a consequence of state subsidies, alter their original course of conduct by becoming market orientated,which contributes to tensions in relations with other collaborators. The second and third articles focus on the situation of Bulgarian-Roma berry pickers in the 2012 harvesting season. Thesearticles illuminate on the one hand, the driving forces to their labour migration and the challenges faced in Sweden, and on the other, the emergence of different collective actions and their significance for the workers. The fourth article centres on two trade union initiatives for the inclusion of undocumentedmigrant workers. The article analyses the challenges faced by the unions as they seek to extend solidarity to workers who are relegated to informal work. The article also elucidates that this endeavour,nonetheless, may have the potential to transform the political identity of trade unions and, by extension through collaborations with other collective actors, open the doors of solidarity for precarious EU migrants. In sum, the four articles show that there is a broad range of collective actors who are preparedto assist precarious migrant workers and to negotiate and at best improve their labour market conditions.These actors face many and difficult challenges. However, as the dissertation demonstrates, their engagement has made the reality of precarious migrant work visible to the public, legitimised the workers’ needs and enabled them to claim their rights.

Mobility partnerships between the EU and third countries are usually viewed as reflecting asymmetric power relations where development aid, trade relations and visa policies are made conditional upon the cooperation by third countries with an EU agenda of migration control. This book argues that three main factors condition the relevance of Mobility Partnerships: the state of relations between EU Member States and a third country, and in particular, the role of postcolonial ties; the power of negotiation of a third country, which is linked to its geopolitical importance for the EU; and its administrative capacity, which is understood as the capacity of a state to define and implement policies and to legislate and enforce the law. The work combines a comparative legal analysis of the development of the legal and policy frameworks in the cases of Morocco and Cape Verde with an empirical study of the implementation of Mobility Partnerships’ projects. The analysis demonstrates that Mobility Partnerships, despite their non-binding nature, have legal and policy relevance for these third countries with regard to the regulation of migration, asylum, human trafficking and even labour law. As such, this book makes a contribution to the understanding of the interplay between the interests of EU, Member State and third country actors in the implementation of the Mobility Partnerships. The book will be a key resource for academics and students focusing on Migration Law, EU Studies, Geopolitics and African Studies. From emergency lending to macro-economics, border management to Brexit, policies are pursued unconventionally and as measures of last resort. This book investigates the nature, rise, and implications of this politics of emergency as it appears in the transnational setting. As the author argues, recourse to this method of rule is an expression of the deeper weakness of executive power in today's Europe. It is how policy-makers contend with rising socio-economic power and diminishing representative ties, seeking fall-back authority in the management of crises. In the structure of the EU they find incentives and few impediments. Whereas political exceptionalism tends to be associated with sovereign power, here it is power's diffusion and functional disaggregation that spurs politics in the emergency mode. The effect of these governing patterns is not just to challenge and reshape ideas of EU legitimacy rooted in constitutionalism and technocracy. The politics of emergency fosters a counter-politics in its mirror image, as populists and others play with themes of necessity and claim the right to disobedience in extremis. The book examines the prospects for democracy once the politics of emergency takes hold, and what it might mean to put transnational politics on a different footing.
