Frequently cited by legal historians, it has nonetheless remained inaccessible to readers unable to master its difficult Old French. Now, F. R. P. Akehurst presents the text's first English translation, making this vital component of the vernacular law of thirteenth century France available to a wide range of scholars. A hybrid text, the Etablissements was probably compiled by a lawyer around the year 1273. The book takes its name from its first part, a set of nine ordinances of Louis IX giving the rules of procedure for the court of the Chatelet in Paris. The second part, made up of one hundred and sixty-six short chapters, is a collection of the customary laws of the Touraine-Anjou region; the thirty-eight chapters of the third section record the laws of the Orleans region. Whereas the Touraine-Anjou material presents a broad treatment of many aspects of the law, the Orleans customary reveals a preoccupation with problems of jurisdiction in a region where the king and local authorities were in sharp competition for power.

Warranty refers to the commitments that an individual undertook when alienating property to protect the transfer from outside challenge, and to provide compensation if they failed to defend a transaction successfully. The subject has never received a full-length study before, meaning that scholars’ interpretation of warranty is marred by a number of untested generalisations. Warranty has generally only been viewed as a thirteenth-century development owing to the influence of Roman law and changes in family structure. This book, therefore, considers the evidence for warranty in western France en masse, starting with the first appearance of warranty clauses in documents in the 1040s up until the compilation of vernacular lawbooks in the 1270s. This book opens a window onto legal practice in the central Middle Ages, raising questions about wider processes of legal change. It emphasises the importance of lordship, in particular, when it comes to making sense of how and why warranty obligations developed the way they did. It thus challenges the prevailing explanatory narratives invoked by scholars when discussing warranty, and invites us to ask questions about the sorts of stories we tell when looking at legal change. Combining documentary and prescriptive lawbooks, along with a rich corpus of case material, this book offers a comprehensive account of a little-studied phenomenon, one that can elucidate much larger interpretative questions that are central to French legal history.

Organized around three closely related themes - the prince as a just ruler, the figure of the judge, and the role of the queen in relation to matters of justice - the issues addressed in these studies, such as what constitutes a just war, what treatment should be meted out to prisoners, what personal qualities are needed for the role of lawgiver, and what limits are placed on women’s participation in judicial processes, are ones that are still the subject of debate today. What the contributors show above all is the degree of political engagement on the part of writers and artists responsible for cultural production in this period. With their textual strategies of exemplification, allegorization, and satirical deprecation, and their visual strategies of hierarchical ordering, spatial organization and symbolic allusion, these figures aimed to show that the pen and paintbrush could aspire to being as mighty as the sword wielded by Lady Justice herself.
