Book Cultural Transfers in Dispute

Download or read book Cultural Transfers in Dispute written by Bee Yun and published by Campus Verlag. This book was released on 2011-08-08 with total page 337 pages. Available in PDF, EPUB and Kindle. Book excerpt: Our conception of cultures and cultural change has altered dramatically in recent decades: no longer do we understand cultures as isolated units; rather, we see them as hybrid formations constantly engaged in a multidirectional process of exchange and influence with other cultures. Yet the very process by which we represent these cultural transfers is itself subject to cultural, political, and ideological conditions that affect our understanding, acknowledgment, and representation of them. Built around concrete examples of controversial representations of cultural transfer from Asia, the Arab world, and Europe, Cultural Transfers in Dispute presents a critical self-reflection on the scholarly practices that underpin our attempts to study and describe other cultures.

Book The Impact of the Convention on the Elimination of All Forms of Discrimination against Women on the Domestic Legislation in Egypt

Download or read book The Impact of the Convention on the Elimination of All Forms of Discrimination against Women on the Domestic Legislation in Egypt written by Nora Salem and published by BRILL. This book was released on 2017-12-05 with total page 242 pages. Available in PDF, EPUB and Kindle. Book excerpt: By virtue of ratifying the Women’s Convention, Egypt is internationally obliged to eliminate gender discrimination in its domestic legislation. Yet, women in Egypt face various forms of discrimination. This may legally be justified through Sharia-based reservations, which many Muslim-majority countries enter to human rights treaties to evade an obligation of implementation where Human Rights run counter to Sharia. This book examines the compatibility of Sharia-based reservations with international law and identifies discrepancies between Sharia and domestic law in order to determine rights Egyptian women are entitled to according to Sharia, and yet denied under Egyptian law. Account is moreover given to Egypt’s implementation efforts in the non-reserved areas of law. To this end, Egypt’s 2014 Constitution and four areas of statutory law are examined as case studies, namely, female genital mutilation; human trafficking; nationality; and labor law.

Book Crossroads of Insolvency and Arbitration

Download or read book Crossroads of Insolvency and Arbitration written by Ishaan Madaan and published by Kluwer Law International B.V.. This book was released on 2022-06-09 with total page 310 pages. Available in PDF, EPUB and Kindle. Book excerpt: Comparative Law Yearbook of International Business, Volume 43A Each year, a Special Issue of the Comparative Law Yearbook of International Business is published under the auspices of the Center for International Legal Studies. The 2022 Special Issue addresses the intersection of arbitration and insolvency. This junction has been made all the more topical and intense by the adverse effects of Covid-19 on a broad range of businesses’ finances and supply chains, and by the still growing recourse to arbitration (and other forms of alternative dispute resolution) to resolve business disputes. A diverse pool of contributors gives a broad range of perspectives from Europe (Italy, Lithuania, the United Kingdom), the Middle East (Palestine, UAE), Asia (India), Africa (Zimbabwe), North America (Canada) and public international law on several common issues posed when one or more parties to an arbitration (agreement) are faced with a financial crisis – or vice versa when an overindebted party is expected to resolve claims that it has or faces, not in State courts but before “private” adjudicators. This Special Issue is aimed at bringing to fore the multitude of issues that exist at the convergences of the domains—a step toward better understanding the intricacies and the complexities that arise in different jurisdictions, and how stakeholders react. To highlight just a few of the aspects addressed: the law to be applied by arbitral tribunals in regard to insolvency issues; insolvency arbitrations and tax claims; how the representatives of bankrupt entities may participate in international investment claims; avoidance of transactions and anti-suit injunctions; and the uneasy but unavoidable cohabitation of insolvency and arbitration in the Middle East and North Africa Region.

Book The Theory of Contracts in Islamic Law A Comparative Analysis with Particular Reference to Modern Legislation in Kuwait Bahrain and the U A E

Download or read book The Theory of Contracts in Islamic Law A Comparative Analysis with Particular Reference to Modern Legislation in Kuwait Bahrain and the U A E written by Susan E. Rayner and published by Springer. This book was released on 1991-11-25 with total page 488 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the discovery of oil in the Middle East an increasing number of important contracts must be framed in accordance with the Shari'a. Moreover various factors have helped to create among Muslims a more acute sense of an original Islamic identity & a collective feeling that Shari's should govern their lives not only with regard to personal & family matters but also as a valid & reasonable corpus of commercial & civil laws. The ban on taking interest (riba) & the rejection of chance contracts (gharar) are two features of an Islamic law of contract which contrast with the secular man-made legal systems of the West. This book is concerned with these two Islamic Prohibitory rules & with the interest-free banking system which has developed therefrom. This is a new enlarged edition where the comparative examination of the topics of the book is updated & furthermore extended to cover the Shi'a Ja'fari fiqh. As a result all aspects are examined in the light of the teachings of the four Sunni schools -which hold authority in the Arab states & in Pakistan -of the Ibadis strongly present in Oman & of the Shi'a Ja'faris prevalent in Iran & largely present in Iraq, Bahrein, Kuweit & Lebanon. The new edition will confirm the use of the initial one as a text book with a particular appeal to academics & practising lawyers. It also provides an insight into the religious & idealogical foundations claimed by Islamic banking.
