Available in PDF, EPUB and Kindle. Book excerpt: "Persuasion is a deliberate effort to change a person's attitude. The ability to persuade is dependant on several things, including the speaker's credibility and likeability, understanding the audience, and how the message is framed. The ability to persuade comes naturally to some people and is completely foreign to others. But regardless of where you fall on that spectrum, understanding the principles of persuasion will increase your ability to persuade - and your ability to sway a jury in your client's favor. The Science of Persuasion is your thorough guide to the way jurors make decisions, and how you can use that knowledge to convince them that your story of a case is the correct version. The author - who holds a Ph. D in psychology, for which he researched persuasion and juror decision-making - walks you though every stage of the trial and offers comprehensive information on what jurors are thinking when, and how to influence them in the most effective ways. Chapters include: principles in persuasion; preparing for trial; witness preparation; voir dire; opening statements; evidence; closing arguments; deliberations; putting it into practice. The book was written for law students, experienced litigators; and everyone in between who needs to understand the most effective ways to convince a jury, and includes extensive sample voir dire questions, opening and closing statements, and fact patterns"--Unedited summary from book cover.

Book Jury Speech Rules

    Book Details:
  • Author : David M. Malone
  • Publisher : Aspen Publishing

  • Pages : 101 pages

Download or read book Jury Speech Rules written by David M. Malone and published by Aspen Publishing. This book was released on 2017-09-22 with total page 101 pages. Available in PDF, EPUB and Kindle. Book excerpt: Jury Speech Rules shows trial lawyers that persuasive jury opening statements and closing arguments require imagination, story-telling skills, and a thorough knowledge of the legal and ethical rules that govern this important part of trial. Using famous historical cases and many useful examples, the authors demonstrate when things go wrong and when they are done right. Opening statements can present the important facts to the jury from the party's perspective, making the jurors receptive to the story that counsel intends to tell through the witnesses, documents, and visuals; well-constructed and well-delivered openings, which avoid improper argument, make an interesting introduction of the parties and the attorneys. Counsel can keep the other lawyer quiet by presenting an opening that provides no opportunity for interruption with objections. Closing arguments that can present inferences, arguments, and conclusions will help the jurors understand the significance of the facts that have been proven at trial; such arguments can explain the significance of expert testimony; they can point out logical errors in the opponents' stories; and they can win the jurors' by persuading them that the more interesting story—the more natural story, the story that fits their own experiences best—is the truthful story.

Book Quintilian and the Law

Download or read book Quintilian and the Law written by Olga Eveline Tellegen-Couperus and published by Leuven University Press. This book was released on 2003 with total page 344 pages. Available in PDF, EPUB and Kindle. Book excerpt: The art of persuasion, as practised today in political debate as well as in the courts of law, has been developed in the rhetorical tradition, but its authors have disappeared from view. One of them was Quintilian, who wrote his Institutio oratoria at the end of the first century AD. This book is special because it contains one of the fullest surveys of rhetorical insights ever written and because it has come down to us in its entirety. Quintilian's rhetorical system has been used in teaching rhetoric at universities since the Middle Ages. The purpose of 'Quintilian and the Law' is to reintroduce Quintilian's Institutio oratoria to modern readers, and to show that the topics discussed in it are still very much alive today. To that end, modern experts of law and rhetoric present their views on the Institutio oratoria, each dealing with one of the twelve books of which it consists. The authors were free to choose their own way of working, so that some books are described in their entirety, others are discussed from one particular point of view, and others still are treated only with regard to a particular section. In Roman times, the shortest way to a political career was by working in the law courts. There, one could acquire a reputation for having a thorough knowledge of the law and for being able to speak well in public. In his Institutio oratoria, Quintilian not only formulated important insights in juridical argumentation, in the art of speech-writing, and in the performative aspects of advocacy, he also discussed the ethical problems involved. Because Quintilian larded his instructions with numerous examples from practice, his book takes us back into the Roman law courts and helps us experience their exciting atmosphere. The essays in this book reflect the wide range of subjects discussed by Quintilian. They deal with (one of) six themes: (1) the ideal orator in a historical perspective, (2) his education, (3) rhetoric and communication, (4) argumentation, (5) Roman law in the Institutio oratoria, and (6) emotions in the courtroom. However, in honour of its author, they are arranged in the order of the Institutio oratoria.

Available in PDF, EPUB and Kindle. Book excerpt: An invaluable resource for experienced trial attorneys, inexperienced trial attorneys looking to advance to the next level of trial practice, and corporate counsel who handle litigation, this book looks at the role courtroom psychology plays in modern trial practice. It covers the essentials of trial practice, including jury selection, opening and closing statements, and questioning witnesses, as well as the key aspects of arbitration hearings and mediations. But what makes this book different from basic trial advocacy primers is its attention to the results of decades of scientific research relating to courtroom psychology (or persuasion psychology). This area concerns how and why jurors, judges, and arbitrators make decisions and how they are influenced. This book examines the role persuasion psychology plays in modern trial practice and how lawyers can use it to their advantage.

Book Lawyers Judges Semi Rational Beasts

Download or read book Lawyers Judges Semi Rational Beasts written by Daniel E. Holloway and published by Daniel Holloway. This book was released on 2020-01-22 with total page 381 pages. Available in PDF, EPUB and Kindle. Book excerpt: Lawyers, Judges & Semi-Rational Beasts surveys the cognitive science literature to distill the main findings that matter for persuasion in any context involving deliberative decision-making — with a focus on the legal context. The book assembles those findings into a coherent model of human decision-making and identifies foundational principles on which legal advocacy (or indeed, advocacy in most contexts) should be based. “You can spend the next 5 years reading every good book on persuasion, or you can read this one elegantly written book by Dan Holloway. But this is more than a summary of what others have written; it is a brilliant integration of what others have written into a powerful perspective on persuasion for the trial lawyer.” — Richard H. Friedman, Inner Circle of Advocates; co-author of Rules of the Road; author of Polarizing the Case and On Becoming a Trial Lawyer “Lawyers spend their careers attempting to persuade judges, jurors, clients, adversaries, and the press to adopt their positions — without giving sufficient thought to what would motivate those audiences to do so. Dan Holloway has drawn together a fascinating analysis of the inner workings of the human mind and how lawyers can apply that knowledge to persuade different types of thinkers. A valuable analytical tool for any attorney’s arsenal.” — Robert J. Dwyer, Boies Schiller Flexner LLP “In easy, engaging prose, this book provides indispensable light for anyone engaged in the foggy, mysterious work of persuasion. Every law firm should provide a copy to each of its lawyers.” — Lawrence B. Schlachter, MD, JD, Neurosurgeon (retired); medical malpractice attorney (active); author of Malpractice: A Neurosurgeon Reveals How Our Health-Care System Puts Patients at Risk “Crossing back and forth through the permeable membrane between the conscious and the unconscious realms where decisions sprout, Dan Holloway guides us on a meticulous, no-stone-unturned quest to reveal what determines how jurors or judges hear or read what the advocate speaks or writes. As Dan explains, persuasion is a matter not of proof, but of people: No one should be disappointed or disturbed to realize how little the “I” yammering away in your head actually controls. It’s mainly the unconscious self we love — the way you wear your hat, the way you sip your tea, the way you grin when your niece walks in . . . all the things you do without thinking about it. Those define you most. Those are the reasons people like you (or don’t). You hardly need me to say that all of this holds true as much for judges and law clerks and jurors as it does for you. Their responses to your brief or your trial presentation will derive largely from unconscious processes. Actually, Dan, we do need you to say it, and particularly in the depth and breadth of observation with which you have considered it in this book.” — Joshua Karton, communication and trial consultant; co-author of Theater for Trial with David Ball “Full of surprising facts and strikingly original observations, this book manages to combine sound practical advice for lawyers with a profound meditation on human thought, motivation, and behavior.” — Louis Michael Seidman, Carmack Waterhouse Professor of Constitutional Law, Georgetown University Law Center “A comprehensive study of the science and art of persuasion – boiled down to effective tools for winning over judges and juries (and your spouse and teenage child too).” — Mauricio Gonzalez, DLA Piper “The lessons and information Holloway provides would be valuable in any law school classroom. In particular, this book could serve as a key text in a stand-alone class on persuasion. It could also be a valuable supplemental resource in a variety of legal writing, clinical, and other courses that merge theory and practice.” — Ann Mallatt Killenbeck, Professor of Law, University of Arkansas “This book distills a library of cognitive science literature into a concise description of how human beings think and decide. Dan Holloway’s book provides the bedrock foundation from which all lawyers should work. It is required reading for anyone who wants to persuade.” — Lloyd N. Bell, medical malpractice attorney and member of the Inner Circle of Advocates
