In the wake of an unprecedented global financial crisis and a sharp surge of investment arbitration cases, states around the world are reflecting on the pros and cons of the current liberal investment regime and exploring new ways ahead. This book brings together leading investment lawyers from more than 20 main jurisdictions of the world to tackle the challenge of producing a first comparative study of foreign investment law. Part I of the book presents a comparative overview of key aspects of foreign investment protection in the world today, including admission, investment contracts, treatment standards, tax regime and incentives, performance requirement, property and expropriation, monetary transfer and dispute settlement. Part II presents in-depth and detailed accounts of the investment laws of more than 20 jurisdictions, including Argentina, Australia, Canada, China, Croatia, Czech Republic, Ethiopia, France, Germany, Greece, Italy, Japan, South Korea, Macau, Peru, Portugal, Russia, Singapore, Slovenia, Turkey, the UK and the USA. Download or read book Draft Defamation Bill written by Great Britain: Ministry of Justice and published by The Stationery Office. This book was released on 2011-03-15 with total page 130 pages. Available in PDF, EPUB and Kindle. Book excerpt: This consultation paper sets out the Government's proposals for reform of the law on defamation, aiming to achieve balance between protection of freedom of speech and the protection of reputation. The Government wants to ensure that the threat of libel proceedings is not used to frustrate robust scientific and academic debate, or to impede responsible investigative journalism and the valuable work undertaken by nongovernmental organisations. Issues included in the draft Bill are as follows: a new requirement that a statement must have caused substantial harm in order for it to be defamatory; a new statutory defence of responsible publication on matters of public interest; a statutory defence of truth (replacing the current common law defence of justification); a statutory defence of honest opinion (replacing the current common law defence of fair/honest comment); provisions updating and extending the circumstances in which the defences of absolute and qualified privilege are available; introduction of a single publication rule to prevent an action being brought in relation to publication of the same material by the same publisher after a one year limitation period has passed; action to address libel tourism by ensuring a court will not accept jurisdiction unless satisfied that England and Wales is clearly the most appropriate place to bring an action against someone who is not domiciled in the UK or an EU Member State; removal of the presumption in favour of jury trial, so that the judge would have a discretion to order jury trial where it is in the interests of justice.

Book Framework for a Fairer Future the Equality Bill

Download or read book Framework for a Fairer Future the Equality Bill written by Great Britain. Government Equalities Office and published by The Stationery Office. This book was released on 2008-06-26 with total page 40 pages. Available in PDF, EPUB and Kindle. Book excerpt: This document sets out the Government's aims for the forthcoming Equality Bill. A substantial body of equality legislation has been introduced over the last four decades, but the legislation has become complex and hard to understand. The Equality Bill will declutter and strengthen the law. The Bill will introduce a new Equality Duty on the public sector, replacing the three existing duties on race, disability and gender and extending to gender reassignment, age, sexual orientation and religion or belief. The Bill will contain powers to outlaw unjustifiable age discrimination, but there will be further consultation on the design of the legislation before the new legal protections are introduced. Transparency is essential to tackling discrimination, and public bodies will have to comply with the Equality Duty over gender pay, ethnic minority employment and disability employment. The Government will work with business to improve transparency in the private sector. The Bill will extend the scope of positive action so that employers can take account, when selecting between two equally qualified candidates, under-representation of disadvantaged groups. Permission to use women-only shortlists for parliamentary candidates will be extended to 2030. Non-legislative measures to increase the number of ethnic minority elected representatives in Parliament and local councils will be pursued. Finally the Bill will aim to strengthen enforcement. Tribunals will be allowed to make wider recommendations in discrimination cases, which will go beyond benefitting the individual taking the case so that there are benefits for the rest of the workforce of the employer found to have discriminated. A more comprehensive paper on the content of the Bill will be published shortly.

Book The High Commissioners

Download or read book The High Commissioners written by Carl Bridge and published by . This book was released on 2010-01-01 with total page 342 pages. Available in PDF, EPUB and Kindle. Book excerpt: Marks the centenary of the posting of the first Australian High Commissioner in London, so beginning what is today Australia's oldest diplomatic mission. In 1910, when Sir George Reid was appointed its first High Commissioner in London, Australia was a self-governing but not yet sovereign state and the Australian Governor-General remained the most important channel of communication between the Australian and United Kingdom governments until the late 1920s. The book traces the history of the office and in doing so illuminates the larger story of Australian-United Kingdom relations in the twentieth century, the evolution of Australia from British colony to sovereign state and the gradual transition of the United Kingdom from head of an empire to member of the European Union.
