It must not be forgotten that all his arguments at the bar were intended to be heard, not read; and that, as he delivered them, every clause was understood, and the general effect which the orator wished to produce was reached at the conclusion of the sentence. Mr. Choate's ear for music demanded a rhythmical sentence. That might be known from the intonations of his voice, from the pathos and sweetness of his cadences. Indeed, I think one of the secrets of his fascination as a lecturer was his frequently chanting periods in a low, rich voice, that accompanied his thought like the sweet tones of a harp. Book The Transformation of American Law 1780 1860

Download or read book The Transformation of American Law 1780 1860 written by Morton J. HORWITZ and published by Harvard University Press. This book was released on 2009-06-30 with total page 378 pages. Available in PDF, EPUB and Kindle. Book excerpt: In a remarkable book based on prodigious research, Morton J. Horwitz offers a sweeping overview of the emergence of a national (and modern) legal system from English and colonial antecedents. He treats the evolution of the common law as intellectual history and also demonstrates how the shifting views of private law became a dynamic element in the economic growth of the United States. Horwitz's subtle and sophisticated explanation of societal change begins with the common law, which was intended to provide justice for all. The great breakpoint came after 1790 when the law was slowly transformed to favor economic growth and development. The courts spurred economic competition instead of circumscribing it. This new instrumental law flourished as the legal profession and the mercantile elite forged a mutually beneficial alliance to gain wealth and power. The evolving law of the early republic interacted with political philosophy, Horwitz shows. The doctrine of laissez-faire, long considered the cloak for competition, is here seen as a shield for the newly rich. By the 1840s the overarching reach of the doctrine prevented further distribution of wealth and protected entrenched classes by disallowing the courts very much power to intervene in economic life. This searching interpretation, which connects law and the courts to the real world, will engage historians in a new debate. For to view the law as an engine of vast economic transformation is to challenge in a stunning way previous interpretations of the eras of revolution and reform.

Book excerpt: "This vitally important book asks: Can the precautionary principle make uncertainty judiciable in the context of liability for the consequences of climate change, and, if so, to what extent? Drawing on the full range of pertinent existing literature and case law, the author examines the precautionary principle both in terms of its content and application and in the context of liability law. She analyses the indirect means offered by existing legislation being used by environmental groups and affected individuals before the courts to challenge both companies and regulators as responsible agents of climate change damage"--Page 4 of cover.

Book excerpt: The patent system is criticized today by some practitioners and economists. In fact, there is a partial disconnection between patent demographics and productivity gains, but also the development of actors who do not innovate and who develop business models that their detractors equate with a capture of annuities or a dangerous commodification of patents. This book provides a less Manichaean view of the position of patents in the system of contemporary innovation. It first recalls that these criticisms are not new, before arguing that if these criticisms have been revived, it is because of a partial shift from an integrated innovation system to a much more fragmented and open system. This shift accompanied the promotion of a more competitive economy. The authors show that this movement is coherent with a more intensive use of patents, but also one that is more focused on their signal function than on their function of direct monetary incentive to innovation.

Download or read book The American Law School Review Vol 3 written by A. F. Mason and published by Forgotten Books. This book was released on 2017-10-31 with total page 744 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The American Law School Review, Vol. 3: An Intercollegiate Law Journal; November, 1911 The law is a system of rules evolved by society and evolving with the alteration of ao clety. The rules are not hard and fast and clear-cut, for they are rules applied and to be applied to the facts of real life, facts varying both apparently and actually. Our knowledge of these rules tends to become static. The rules themselves seldom do. Almost every rule has a future growth, as well as a past development. A most vain able phase of legal lore to be imparted to a student of any rule of law is its dynamic force. What is the trend of its development? What is the law of the future? The future, of course, is always beginning with the com ing moment. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
