Book excerpt: The ongoing crisis in the island Republic of Cyprus that is caused by the continuing Turkish military occupation since 1974 must be resolved - in accordance with established principles of international law, and in view of the forthcoming accession of the Republic of Cyprus to the European Union (EU). The resolution of the Cyprus crisis can and should proceed independently from the negotiations concerning the EU accession and the broader geopolitical concerns that involve the Middle East region. The independent island Republic of Cyprus is a credible candidate for accession to the EU community of nation-states, in accordance with its established criteria. However, the prospects of peace, security and prosperity for the Cypriots are clouded by the continuing illegitimate Turkish military occupation of approximately 40 percent of the Island's territory since 1974. Indeed, Turkey has threatened the use of military force and outright annexation of the occupied sector should the EU grant Cyprus' accession application. This SRP will analyze the Cyprus crisis and will show that its resolution can be based on existing principles of international law as they have been manifested in various UN Security Council and. General Assembly resolutions regarding this crisis. Furthermore, the analysis will show that the resolution of the Cyprus crisis can be based on Cyprus' accession to the EU which will benefit all ethnic and religious segments of the Cypriot population. In addition to those, the resolution of the Cyprus crisis will lead to improved prospects for Turkey's accession to the EU, the permanent improvement of Greek-Turkish relations and the consequent strengthening of NATO's flank in the Southeastern Mediterranean.

The book addresses a question which is of great significance for the legal order of the EU (as well as for Cypriots, Turks and Greeks), namely how the Union deals with the de facto division of the island. Despite the partial normalisation of relations between the two ethno-religious groups on the island, Cyprus' accession to the EU has not led to its reunification, nor to the restoration of human rights, nor a complete end to the political and economic isolation of the Turkish Cypriot community. Ironically enough, the accession of the island to the EU actually added a new dimension to the division of the island. According to Protocol 10 on Cyprus to the Act of Accession 2003, the Republic of Cyprus joined the Union with its entire territory. However, due to the fact that its Government cannot exercise effective control over the whole island, pending a settlement, the application of the acquis is 'suspended in those areas of the Republic of Cyprus in which the Government of the Republic of Cyprus does not have effective control.' Given this unprecedented (for an EU Member State) situation of not controlling part of its territory, the book analyses the limits of the suspension of the Union acquis in the areas north of the Green Line. In other words, the telos of this particularly challenging research is to map the partial application of Union law in an area where there are two competing claims of authority.

Book excerpt: The Republic of Cyprus was placed under British administration in 1878 until independence in 1960 (The Zurich and London Agreements). With these agreements, Cyprus became a constitutional democracy and is now a member of both the United Nations and the European Union. The Republic of Cyprus is recognized internationally as it's government is considered to be the legitimate government of the whole island. In the years after the recognition of Cyprus as a democracy, inter-communal violence broke out and UN forces were deployed in Cyprus. An attempted invasion of Cyprus by Turkey in 1964 was put to an end by the US President Lyndon Johnson. In 1967, Rauf Denktas and Glafkos Klerides tried to negotiate a settlement, which led to a temporary relief of the tension between both parties. However, a coup d'etat of 1974 led to extreme violence between Greek and Turkish Cypriots, resulting in the invasion and occupation by Turkey in July 1974. From that moment on, Turkey controls the northern part of the island. This part of the island is not under effective control of the republic and is recognized by Turkey since 1983 as the Turkish Republic of Northern Cyprus (TNRC), but is not recognized by the international community. UN Security Council Resolution 541 (1983) does not recognize the TNRC as lawful and called upon Turkey to retreat from northern Cyprus. The resolution furthermore called upon others not to support and recognize the TNRC. The last major effort to settle the dispute dates from 2004, when UN Secretary General Kofi Annan tried to negotiate reunification of both sides of the Island. Direct reason to start these negotiations was Cyprus' upcoming membership of the EU. This UN Comprehensive Settlement of The Cyprus Problem, known as the 'Annan (Peace) Plan, ' organized referenda in both the north and the south, but gained support of the Turks only, as it was rejected by the Greeks. At present, there is a ceasefire between both parties, even though the UN still deploys troups. This book offers a selection of historical documents, including the ones mentioned above, and provides an overview of the international dispute that has been going on for decades. The book will be of interest to those who work on the dispute between Cyprus and Turkey, as well as for those who wish to know more about the involvement of the international community in the Cyprus conflict
