Este primer volumen se destina al estudio de los fundamentos del derecho probatorio y temas que pueden ser derivados de la teoría general de la prueba como son el convencimiento judicial y de la motivación. En esta perspectiva, se analizan también las cuestiones de las presunciones, las reglas de la experiencia, la carga de la prueba, la prueba del hecho temido, la legitimidad del juzgamiento de mérito basado en la verosimilitud, la prueba ilícita, la revisión de la prueba mediante los recursos especiales y extraordinarios, entre otros. Luiz Guilherme Marinoni es profesor titular de Derecho Procesal Civil en los cursos de pregrado, maestría y doctorado de la Facultad de Derecho de la Universidad Federal de Paraná – UFPR. Profesor invitado en varias universidades de América Latina y Europa. Vicepresidente de la Asociación Brasileña de Derecho Procesal Constitucional. Miembro del Consejo Consultivo del Instituto Brasileño de Derecho Procesal – IBDP y de la Asociación Internacional de Derecho Procesal – IAPL. Director del Instituto Iberoamericano de Derecho Procesal – IIBDP. Sérgio Cruz Arenhart es magíster y doctor por la Universidad Federal de Paraná – UFPR y postdoctor por la Università degli Studi di Firenze.
