Download or read book Disputes and Dilemmas in Health Law written by Ian R. Freckelton and published by Federation Press. This book was released on 2006 with total page 740 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book replaces the successful Controversies in Health Law. Under the same editorship and much the same authorship, it is substantially larger (30 chapters instead of 18) and correspondingly more comprehensive. It retains the lively analysis and the focus on controversial and cutting-edge problems. The chapters are broken up into parts covering Litigation and Liabilty; Reproductive Technologies; The Sequelae of the End of Life; Public Health; Ethical Frameworks and Dilemmas; Regulation; Human Rights and Therapeutic Jurisprudence; Research and Vulnerability and Information, Privacy and Confidentiality . They consider issues raised by new technologies, changing legislation and altering community expectations; by new regulatory processes for medicine and all of the health professions; by the fundamental changes to civil liability for medical negligence; by the fierce debate over the role of coroners. Disputes and Dilemmas in Health Law covers questions on property in human tissue and on the ethical and legal aspects of the genetics revolution; provides a modern take on "old" issues such as reproductive law; takes account of changes relating to expert evidence; and discusses how difficult cases in relation to psychiatric injury and wrongful life are pushing compensability to its edges.
Download or read book Inheritance Matters written by Suzanne Lenon and published by Bloomsbury Publishing. This book was released on 2023-09-21 with total page 337 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book makes a compelling case for placing the social and legal practices of inheritance centre stage to make sense of fundamental questions of our time. Drawing on historical, literary, sociological, and legal analysis, this rich collection of original, interdisciplinary and international contributions demonstrates how inheritance is and has always been about far more than the set of legal processes for the distribution of wealth and property upon death. The contributions range from exploring the intractable tensions underlying family disputes and the legal and political debates about taxation, to revisiting literary plots in the past and presenting a contemporary artistic challenge of heirship. With an introduction that presents a critical mapping of the field of inheritance studies, this collection reveals the complexity of ideas about 'passing on', 'legacies', and 'heirlooms'; troubles some of the enduring consequences of 'charitable bequests', 'family money', and 'estate planning; and, deepens our understanding of the intimate and political practices of inheritance.

Download or read book Company Law and the Law of Succession written by Susanne Kalss and published by Springer. This book was released on 2015-10-21 with total page 409 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is one of the first to link company law to the law of succession by concentrating on family businesses. It shows that, to understand the legal framework underlying the daily operations of family businesses, one needs legal analysis, empirical data, psychological and sociological knowledge. The book works on the premise that, since many businesses have been founded by families, practitioners need to develop an understanding of the legal background of such businesses and build up experience to be able to create contracts, trusts, foundations and other legal mechanisms to give shape to systems and procedures for the transfer of shares and control within the family. Comparing the national legal order, techniques, and mechanisms in a range of countries, the book examines parallel developments in these fields of law across the world. Finally, it demonstrates the room for companies, shareholders and the members of a family to develop individual solutions within the legal framework for transferring businesses and shares to the next generation.

Download or read book Comparative Succession Law written by Kenneth G C Reid and published by Oxford University Press. This book was released on 2020-10-09 with total page 832 pages. Available in PDF, EPUB and Kindle. Book excerpt: This third volume in a series on Comparative Succession Law concerns the entitlement of family members to override the provisions of a deceased person's will to obtain money or assets (or more money or assets) from the person's estate. Some countries, notably those in the civil law tradition (such as France or Germany), confer a pre-ordained share of the deceased's estate or of its value on certain members of the deceased's family, and especially on the deceased's children and spouse. Other countries, notably those in the common law tradition (such as England, Canada, or Australia), leave the matter to the discretion of the court, the amount awarded depending primarily on financial need. Whichever form it takes, mandatory family provision is both a protection against disinheritance and also, therefore, a restriction on testamentary freedom. The volume focuses on Europe and on countries influenced by the European experience. In addition to detailed treatment of the law in Austria, England and Wales, France, Germany, Hungary, Italy, the Netherlands, Norway, Poland, Scotland, and Spain, the book also has chapters on Australia and New Zealand, South Africa, the United States, Canada, the countries of Latin America, and the People's Republic of China. Some other countries are covered more briefly, and there is a separate chapter on Islamic law. The book opens with accounts of Roman law and of the law in medieval and early-modern Europe, and it concludes with a comparative assessment of the law as it is today in the countries and legal traditions surveyed in this volume.

Download or read book Succession Families Property and Death 6th Edition written by R Croucher; P Vines and published by . This book was released on 2023-11 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Succession: Families, Property and Death is designed not only to expound succession law in Australia as it is, including the recognition, if at all, of Aboriginal customary law, but also to consider the law in its national and international setting by considering rules of private international law; to reveal how it has developed by taking an historical focus; to consider the objectives sought to be satisfied by succession law as a basis of understanding and for the evaluation of existing rules; and to consider some comparative approaches to the problems of inheritance. As a teaching tool, it extracts cases at length rather than in small pieces to enable students to develop a sense of the forms of judicial argument which are used in succession law, allowing for a deeper analysis of the judgments than has traditionally been possible. As a practitioner resource, this text also covers comprehensively and critically such bread-and-butter topics of a succession lawyer as formal validity of a will, challenges to that validity, dispensing with formal requirements for a will, rectification, and claims for a family provision order. Features Includes new commentary on: * digital property * Jewish inheritance law * definition of family for succession purposes, including Aboriginal concept of kinship and posthumous children * joint tenancy and the right of survivorship * voluntary assisted dying * Benjamin orders * disputes about disposal of the body * recognition of aboriginal customary law and tradition in distribution on intestacy * determining capacity and dealing with future loss of capacity * electronic signing and witnessing of wills * formal validity rules and dispensing powers * sale of specific gift after death * ademption of gifts * the forfeiture rule * family provision * administration of the estate Related Titles * Dal Pont, Law of Succession, 3rd edition * Dal Pont, Law of Executors and Administrators, 1st edition * De Groot & Nickel, Family Provision in Australia, 6th edition * Mackie & Histed, Principles of Australian Succession Law, 4th edition

Download or read book Family Property Law written by Lawrence W. Waggoner and published by . This book was released on 2006 with total page 1050 pages. Available in PDF, EPUB and Kindle. Book excerpt: A forward-looking casebook, Family Property Law focuses on new themes in family property law in the areas of wills, trusts, estates, and probates. The book recognizes the reform-minded nature of the current era of family property law, including its changing notions of family and society, the acceptance of a partnership theory for assessing the financial aspects of marriage, and the need to reshape the law of donative transfers into a unity. The third edition presents the following new features: integrated coverage of the new Uniform Trust Code and of the American Law Institute-approved parts of the new Restatements; important new case and statutory law, including Vermont's civil union statute and a sample certificate of civil union; the two Kuralt decisions of the Montana Supreme Court holding that Charles Kuralt's letter to his mistress constituted a holographic will; and fully integrated treatment of the Economic Growth and Tax Relief Reconciliation Act of 2001, which ultimately repealed the estate tax and the generation-skipping transfer tax.
