Book Looking for Rights in All the Wrong Places

Download or read book Looking for Rights in All the Wrong Places written by Emily Zackin and published by Princeton University Press. This book was released on 2013-04-21 with total page 250 pages. Available in PDF, EPUB and Kindle. Book excerpt: Unlike many national constitutions, which contain explicit positive rights to such things as education, a living wage, and a healthful environment, the U.S. Bill of Rights appears to contain only a long list of prohibitions on government. American constitutional rights, we are often told, protect people only from an overbearing government, but give no explicit guarantees of governmental help. Looking for Rights in All the Wrong Places argues that we have fundamentally misunderstood the American rights tradition. The United States actually has a long history of enshrining positive rights in its constitutional law, but these rights have been overlooked simply because they are not in the federal Constitution. Emily Zackin shows how they instead have been included in America's state constitutions, in large part because state governments, not the federal government, have long been primarily responsible for crafting American social policy. Although state constitutions, seemingly mired in trivial detail, can look like pale imitations of their federal counterpart, they have been sites of serious debate, reflect national concerns, and enshrine choices about fundamental values. Zackin looks in depth at the history of education, labor, and environmental reform, explaining why America's activists targeted state constitutions in their struggles for government protection from the hazards of life under capitalism. Shedding much-needed light on the variety of reasons that activists pursued the creation of new state-level rights, Looking for Rights in All the Wrong Places challenges us to rethink our most basic assumptions about the American constitutional tradition.

Book A Less Perfect Union

Download or read book A Less Perfect Union written by Adam Freedman and published by Broadside Books. This book was released on 2017-05-02 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: One of America’s leading conservative commentators on constitutional law provides an illuminating history of states’ rights, and the vital importance of reviving them today. Liberals believe that the argument for “states’ rights” is a smokescreen for racist repression. But historically, the doctrine of states’ rights has been an honorable tradition—a necessary component of constitutional government and a protector of American freedoms. Our Constitution is largely devoted to restraining the federal government and protecting state sovereignty. Yet for decades, Adam Freedman contends, the federal government has usurped rights that belong to the states in a veritable coup. In A Less Perfect Union, Freedman provides a detailed and lively history of the development and creation of states’ rights, from the constitutional convention through the Civil War and the New Deal to today. Surveying the latest developments in Congress and the state capitals, he finds a growing sympathy for states’ rights on both sides of the aisle. Freedman makes the case for a return to states’ rights as the only way to protect America, to serve as a check against the tyranny of federal overreach, take power out of the hands of the special interests and crony capitalists in Washington, and realize the Founders’ vision of libertarian freedom—a nation in which states are free to address the health, safety, and economic well-being of their citizens without federal coercion and crippling bureaucratic red tape.

Book The Constitution

Download or read book The Constitution written by Michael Shally-Jensen and published by . This book was released on 2022 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: As the supreme law of the country, the Constitution delineates the nation's frame of government and was originally comprised of seven articles. The first three articles put forth the separation of powers (three branches of government), the next three embody the concepts of federalism (rights and responsibilities of the states in relationship to the federal government), and the last article established the procedure used by the then 13 states to ratify it. It has been amended 27 times to meet the needs of a nation that has undergone profound change. The first ten amendments are known as the Bill of Rights and were added at the insistence of Anti-Federalists who sought guarantees of personal freedoms and restrictions on government power. Various other amendments likewise relate to federal authority. The Constitution has remained in force for over two centuries due to the way the framers separated and balanced governmental powers. It is interpreted, supplemented, and implemented by a large body of federal constitutional law, and has influenced the constitutions of other nations. Documents examined in this two-volume set include: Documents from the Constitutional Convention Federalist Papers for and against ratification Articles on the Separation of Powers Amendments on Voting and Elections Debates about Government's Role in Commerce Debates over the key Articles of the Constitution The Bill of Rights Amendments on Federal Authority and States' Rights Amendments safeguarding Justice and Criminal Procedure Supreme Court cases testing Constitutional principles Each in-depth chapter provides a thorough commentary and analysis of each primary source document, often reprinted in its entirety. Commentary includes a Summary, Overview, Defining Moment, Author Biography, Detailed Document Analysis, and discussion of Essential Themes.
