Among its innovations are provisions for facility agreements to govern on-site verification inspections of certain facilities. A facility agreement is an agreement or arrangement between a State Party and the Organization [for the Prohibition of Chemical Weapons] relating to a specific facility subject to on-site verification pursuant to Articles 4, 5 and 6. The purpose of this very brief paper is to discuss the value of specificity in the model facility agreements that are to serve as the basis for facility agreements. The views expressed herein are those of the author alone, and not necessarily those of the government of the US of America or any other institution. The model facility agreements are a key document to national implementation of the CWC. As explained in the Manual for National Implementation of the Chemical Weapons Convention, facility agreements are among the important protections the CWC provides for confidential business information at facilities subject to CWC inspections. Thus, the structure of the models for these agreements will fundamentally determine how national implementation of the Convention will affect various private firms. A particularly salient question that must be addressed in drafting model facility agreements under the CWC is how specific they should be.

An entirely new and complex worldwide regulatory regime, it nevertheless takes account of the need for certainty in the conduct of industrial production. In particular, the CWC provides for site-specific inspection protocols, called {open_quotes}facility agreements{close_quotes}. Facility agreements are not defined in the CWC, but are to be developed as part of the preparations preceding formal entry into force. In effect, they can be thought of as {open_quotes}inspection contracts{close_quotes} governing facilities subject to systematic and routine inspections. Facility agreements are not part of challenge inspections or for cases of alleged use of chemical weapons. The most important fact about facility agreements is that they are not negotiated between the facility owner or operator and the OPCW. Rather, they are negotiated between the State Party and the OPCW. Where United States facilities, such as chemical weapons production facilities, are owned by the government or are under government contract this is not a problem because the government can negotiate on its own behalf. However, where privately owned facilities in the United States enter into facility agreements, the input of those private entities into the terms of the agreement is not guaranteed by the Convention - them OPCW only interfaces with States Parties, not with private firms. The second most important fact is that not all facilities subject to routine inspections must have facility agreements in place. Those declaring chemicals on Schedule 2, Schedule 3 or so-called {open_quotes}other chemical production facilities{close_quotes} may enter into facility agreements, but this is at the option of the State Party.

Book excerpt: The entry into force in 1997 of the Chemical Weapons Convention (CWC) symbolizes the coming of age of the law of arms control as a separate area of international law. It is not only the first treaty whereby a whole category of weapons of mass destruction, viz. chemical weapons, is completely banned, but it also puts into place a comprehensive compliance control system. For this purpose a specialized international organisation has been created with as its sole purpose the supervision of the commitments under this arms control treaty: the Organisation for the Prohibition of Chemical Weapons (OPCW) based in The Hague. Supervision under this Convention is an example of compliance management, which is cooperative rather than adversarial in character, in spite of the elaborate and intrusive inspection regime concerning not only the military component but also the civilian chemical industries worldwide. Thereby not only States Parties' military security concerns are taken care of, but also the concerns of the chemical industries with regard to the protection of confidential business information. In general, this volume aims to provide a better understanding of some of the special characteristics of arms control law. One part of this volume highlights the unique characteristics of the compliance control model by providing a detailed analysis of the CWC, the OPCW and of the specific supervisory functions. The obligations of the signatories to the CWC are discussed in the other part. Although an important topic of general international law, clarity as to the obligations of Signatory States appears to be of special importance in the case of arms control treaties, for, given their securityinterests, it is crucial for States that at a minimum a "status quo" between all the signatories is maintained.
