Book Reflections Upon the Administration of Justice in Pennsylvania Classic Reprint

Download or read book Reflections Upon the Administration of Justice in Pennsylvania Classic Reprint written by Richard Rush and published by . This book was released on 2015-07-12 with total page 74 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Reflections Upon the Administration of Justice in Pennsylvania A Citizen of New York not long ago remarked to me, that, wherever he had been in Pennsylvania, he heard complaints of the bad administration of the laws. In New York, he said, these complaints were not heard. The people there were not only satisfied with their courts of justice, but seemed to take a pride in them. It must be something unusual that would delay the decision of a suit, in that state, longer than a twelvemonth; and, a large majority of the causes was disposed of in nine, and many of them in six, months after they were brought. And yet, he said, the systems of law in the two states were the same, or did not materially differ. Each state had, in an equal degree, its republican institutions and manners. Book excerpt: Classic Books Library presents this brand new edition of “The Federalist Papers”, a collection of separate essays and articles compiled in 1788 by Alexander Hamilton. Following the United States Declaration of Independence in 1776, the governing doctrines and policies of the States lacked cohesion. “The Federalist”, as it was previously known, was constructed by American statesman Alexander Hamilton, and was intended to catalyse the ratification of the United States Constitution. Hamilton recruited fellow statesmen James Madison Jr., and John Jay to write papers for the compendium, and the three are known as some of the Founding Fathers of the United States. Alexander Hamilton (c. 1755–1804) was an American lawyer, journalist and highly influential government official. He also served as a Senior Officer in the Army between 1799-1800 and founded the Federalist Party, the system that governed the nation’s finances. His contributions to the Constitution and leadership made a significant and lasting impact on the early development of the nation of the United States.

Book Some Reflections on Judicial Activism

Download or read book Some Reflections on Judicial Activism written by Robert Juul and published by . This book was released on 2000 with total page 119 pages. Available in PDF, EPUB and Kindle. Book excerpt: The founding fathers of the United States were the authors of the United States Constitution which has served this country well for over two centuries. This book is about judicial activism. There are two important provisions of the Constitution which are involved in this discussion. First, the Constitution provides for the separation of powers in the Federal Government. Second, the Constitution guarantees to every state in the Union a Republican form of government, which gives the people of the States the power to govern themselves. Judicial activism occurs when the United States Supreme Court exercises legislative power. President Washington cautioned those entrusted with the administration of the government to confine themselves within their respective constitutional spheres, avoiding in the exercise of the powers of one department to encroach upon another. When the Supreme Court legislates, it tends to impair the capacity of the State governments to govern themselves. The book contains several historical sketches which describe the development of the rule of law, the development of the common law in England, the making of the United States Constitution, plus several sketches that describe some aspects of the legal systems in the United States. The rule of law was a very important concept that was acquired by the original States from their colonial experience. When the departments of the United States government do not observe and respect the separation of powers, they do not follow the rule of law. Also, included is a Chapter Entitled "The Judicial Assault on Religious Liberty".
