Book Solar Energy Development on the Federal Public Lands

Available in PDF, EPUB and Kindle. Book excerpt: The federal government has endorsed more extensive use of the federal public lands for the production of solar power, both to reduce the greenhouse gas emissions that contribute to climate change and to bolster the security of domestic energy supplies. Spurred by grant money made available under the American Recovery and Reinvestment Act of 2009, the Bureau of Land Management (BLM) in 2010 approved nine utility-scale solar projects on public lands in California and Nevada. These projects were designed to avoid adversely affecting the habitats of endangered and threatened species that frequent the desert southwest and cultural resources important to Native Americans and others. This article analyzes both the environmental risks created by the construction and operation of solar power projects on BLM public lands and the regulatory process the BLM has used to respond to the numerous applications for project approval it has received in recent years. It concludes that the BLM has the responsibility under the Federal Land Policy and Management Act and other laws to minimize resource impairment resulting from solar power production on public lands. The article suggests an approach that relies on a combination of zoning and conditional authorization, including the imposition of restrictions to prevent unnecessary and undue degradation of public natural resources such as wildlife and its habitat. It also discusses how the agency might define such degradation, taking into account the policy benefits of increased solar capacity and the environmental costs of haphazard oversight of the use of public lands for solar power production. Appropriately constrained, dedication of public lands to solar power production can contribute to the development of a more secure green energy infrastructure while minimizing adverse impacts on public natural resources.

This book was released on 2012-06-18 with total page 98 pages. Available in PDF, EPUB and Kindle. Book excerpt: The United States' dependence on foreign oil is one of the gravest national security issues facing our country. If we want to reduce its dependence on foreign oil, we must properly utilize all our resources right here in America. This hearing is critical to exposing federal policies that are prohibiting the industry's job creators from utilizing public lands and developing renewable energy infrastructure. It is important that this Congress learns from today's hearing exactly what agencies and policies are improperly stagnating our renewable energy development.

Book Solar Energy on Arizona Public Lands Environmental Impacts and Stakeholder Perspectives

Download or read book Solar Energy on Arizona Public Lands Environmental Impacts and Stakeholder Perspectives written by Julia Brooke Sittig and published by . This book was released on 2014 with total page 200 pages. Available in PDF, EPUB and Kindle. Book excerpt: With America's recent needs for creating jobs, mitigating greenhouse gas emissions, and becoming "energy independent" from foreign nations, the large-scale deployment of solar energy projects has been proclaimed a solution for rapidly generating "clean" energy. Federal agencies have been mandated by law to expedite the siting of utility-scale solar energy projects (USSEPs) on public lands. In particular, the Bureau of Land Management (BLM) has focused on USSEP development by creating a national solar energy program as well as state-specific programs for encouraging USSEP development, and has thus far approved two USSEPs in Arizona. Although operational USSEPs do not emit greenhouse gases, they are not completely benign to the environment. USSEPs incur negative impacts on soils, vegetation, air quality, and other natural and cultural resources. Because USSEPs have the potential to mitigate climate change, yet incur other negative environmental impacts, the reaction of citizen stakeholders such as environmental advocates to public lands USSEP development has been mixed. Environmental advocate groups have both encouraged BLM to build USSEPs, and filed lawsuits discouraging project development. In light of the ability of environmental advocates to influence USSEP development, this study explored the complex opinions of members of environmental organizations, conservation groups, watershed initiatives, and solar industry professionals regarding USSEP development on Arizona public lands. Through a review of relevant literature, a content analysis of BLM environmental review documents, and the distribution and statistical analysis of an opinion survey, the study provides insight into the implications of the current BLM Arizona siting process and specific, up-to-date stakeholder perspectives. The results indicate that while BLM Arizona siting policies do attempt to address environmental concerns, significant concerns about the current USSEP siting process remain, and that environmental advocates' support for public lands USSEPs is lower than their support for renewable energy development in general. Stakeholders reported having low levels of three items: knowledge of current solar technologies, understanding of the current federal USSEP siting process, and confidence that the government will appropriately site solar energy projects. Addressing those items may alleviate tensions between stakeholders and public lands decision-makers, resulting in faster and more environmentally responsible USSEP siting.

Book Renewable Energy and the Public Trust Doctrine

Download or read book Renewable Energy and the Public Trust Doctrine written by Alexandra B. Klass and published by . This book was released on 2015 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Article explores the role of the public trust doctrine in current efforts to site large-scale wind and solar projects on public and private lands. Notably, both proponents and opponents of such renewable energy projects have looked to the public trust doctrine to advance their goals. Proponents of large-scale renewable energy projects point to the environmental and climate change benefits associated with renewable energy development and argue that the use of public lands and large tracts of private lands to facilitate such projects are both in the public interest and consistent with the public trust doctrine. At the same time, parties opposed to particular renewable energy projects have argued that the land-intensive nature of these projects as well as their potential adverse impacts on endangered species, open space, aesthetic values, and pristine landscapes will result in a violation of the public trust doctrine. Which side is right? How do we balance the benefits and harms of large-scale renewable energy projects and what role should the public trust doctrine play in setting that balance? In addressing these questions, this Article discusses the extent to which the public trust doctrine applies to on-shore and off-shore renewable energy projects on private, state, and federal lands and waters. It then discusses the potential role state and federal legislation can play in codifying or expanding the application of the public trust doctrine with regard to state and federal lands and waters. It concludes by suggesting ways in which existing statutes and new, renewable energy-specific statutes can attempt to build on the public trust doctrine to encourage renewable energy development on public lands without compromising competing public trust values.

This book was released on 2018-06-10 with total page 232 pages. Available in PDF, EPUB and Kindle. Book excerpt: Competitive Processes, Terms, and Conditions for Leasing Public Lands for Solar and Wind Energy Development (US Bureau of Land Management Regulation) (BLM) (2018 Edition) The Law Library presents the complete text of the Competitive Processes, Terms, and Conditions for Leasing Public Lands for Solar and Wind Energy Development (US Bureau of Land Management Regulation) (BLM) (2018 Edition). Updated as of May 29, 2018 Through this final rule the Bureau of Land Management (BLM) is amending its regulations governing rights-of-way issued under the Federal Land Policy and Management Act (FLPMA) and the Mineral Leasing Act (MLA). The principal purposes of these amendments are to facilitate responsible solar and wind energy development on BLM-managed public lands and to ensure that the American taxpayer receives fair market value for such development. This final rule includes provisions to promote the use of preferred areas for solar and wind energy development, called "designated leasing areas" (DLAs). It builds upon existing regulations and policies to expand BLM's ability to utilize competitive processes to offer authorizations for development inside or outside of DLAs. It also addresses the appropriate terms and conditions (including payment and bonding requirements) for solar and wind energy development rights-of-way issued under the regulations. Finally, the rule makes technical changes, corrections, and clarifications to the existing rights-of-way regulations. Some of these changes affect all rights-of-way, while some provisions affect only specific rights-of-way, such as those for transmission lines with a capacity of 100 kilovolts (kV) or more. This book contains: - The complete text of the Competitive Processes, Terms, and Conditions for Leasing Public Lands for Solar and Wind Energy Development (US Bureau of Land Management Regulation) (BLM) (2018 Edition) - A table of contents with the page number of each section
