Sirvan de excusa, pues, estas líneas para volcar aquí, a modo de diálogo con la obra prologada y en homenaje a su método comparatista, algunas reflexiones sobre el sistema propio en alguna medida incentivadas por las sesiones de trabajo y discusión habidas con la autora a lo largo del proceso de gestación de aquélla.

Book excerpt: En el artículo 38 de la Constitución española se dice, en su primer inciso: "Se reconoce la libertad de empresa en el marco de la economía de mercado". Pues bien, la obra que tiene el lector en sus manos se ocupa de la interpretación de este enunciado. Se trata de un asunto complejo, ya que la propia Constitución contiene en su seno enunciados potencialmente devastadores para la libertad de empresa, como muestra el segundo inciso de ese mismo artículo, en el que, después de decirse que los poderes públicos aseguran el ejercicio de esta libertad, así como la defensa de la productividad, se añade que dichas tareas han de llevarse a cabo "de acuerdo con las exigencias de la economía general y, en su caso, de la planificación". La obra se asienta en dos tesis centrales. La primera: la libertad de empresa se reconoce en el marco de un sistema económico determinado, la "economía de mercado", expresión que, lato sensu, es sinónima de "capitalismo de mercado". Esto significa que nuestra Constitución, que no es neutral en cuanto al sistema político, tampoco lo es en cuanto al sistema económico, como tampoco admite la coexistencia de varios sistemas económicos: el único sistema económico admisible es el que expresamente ha incorporado a su seno, con exclusión de los demás. Significa también que nuestra Constitución, si bien delimita el sistema económico atendiendo al conjunto de sus normas (la economía de mercado se reconoce en el marco de la Constitución, no la Constitución en el marco de la economía de mercado), también lo garantiza, siendo así que la garantía constitucional se articula a través de cada una de las piezas de que se compone: propiedad privada, libertad de empresa y mercado. Se hace referencia especial al mercado como instituto garantizado, así como a su necesaria unidad, no sólo desde la perspectiva interna sino también desde la perspectiva comunitaria. La segunda tesis central es que la libertad de empresa no es una mero instituto garantizado, o un derecho subjetivo enteramente subordinado a las exigencias del interés general económico. La libertad de empresa es un derecho fundamental, esto es, un derecho subjetivo constitucional que, justamente por su condición de fundamental, tiene un contenido esencial que debe ser respetado por el legislador. A la determinación de este contenido esencial provee el capítulo central de esta obra. No se olvida el autor de la relevante dimensión objetiva de la norma del artículo 38 de la Constitución, que no limita sino que amplia el derecho subjetivo, en tanto de ella se deriva una habilitación a los poderes públicos para potenciar la libertad de empresa, de la que está siendo manifestación el proceso liberalizador que vive nuestra economía, auspiciado por nuestra integración en la Unión Europea y animado por el fenómeno de la globalización. La liberalización cuenta con legitimidad constitucional, pero también con límites constitucionales, singularmente los derivados de la cláusula de Estado Social. En fin, se trata de una obra de Derecho Constitucional, pero que ha requerido del apoyo de otras disciplinas jurídicas (muy singularmente del Derecho Comunitario), así como de la ciencia económica. Por ello, va dirigida no sólo a juristas, sino a todos los que estén interesados en saber como está regulada en la Constitución española (y en la "Constitución europea") una manifestación tan relevante de la libertad humana como es la libertad económica.

La consideración de tal libertad como derecho subjetivo de rango constitucional, cuyo ejercicio debe ser promovido, garantizado y protegido por la Administración exige que, con ocasión de su ordenación jurídica, aquélla respete un conjunto de garantías jurídicas llamadas a proteger y asegurar su ejercicio efectivo. La elaboración de estas garantías se realiza de cara a los ordenamientos jurídicos de España y Venezuela, efectuando especiales consideraciones en torno a su situación en el marco de la liberalización del sistema económico. De esa manera, la concepción de esa libertad como auténtico derecho subjetivo de rango constitucional que dimana de la libertad general del ciudadano se opone a toda restricción arbitraria a su ejercicio, lo que impone la sujeción de la actividad de la Administración económica a sus garantías jurídicas, que han sido sistematizadas en tres grupos. La primera garantía de la libertad es su contenido esencial, en cuya virtud la libre iniciativa constitucionalmente reconocida debe ser consecuencia, siempre, de la autonomía privada de los operadores económicos. La segunda garantía es la reserva legal, en virtud de la cual toda restricción al ejercicio de esa libertad, aún sutil, debe tener punto de anclaje en la Ley. Finalmente, la libertad de empresa se encuentra protegida por diversas garantías materiales, que permiten enjuiciar toda medida administrativa de restricción a esa libertad en virtud de cuatro parámetros: objetivo (control de la razonabilidad y racionalidad); subjetivo (respeto a la igualdad entre los operadores); temporal (interdicción de medidas administrativas imprevistas) y procedimental (prohibición de retardos injustificados en el ejercicio de la libertad económica debidos a la excesiva formalización del actuar de la Administración).
