California's law was unique, however, because people convicted of possession of a small amount of narcotics or who committed petty crimes like shoplifting were receiving life sentences. Kieso studies prosecutorial discretion, judicial discretion, jury discretion with a focus on the inconsistencies in California's usage of its Three Strikes law. Contrary to the U.S. Supreme Court's 2003 decision, Ewing v. Book excerpt: This report, part of a RAND study of the use of prison and probation for felony offenders, examines offender behavior after imprisonment. Using a sample of comparable prisoners and probationers, the authors investigate the association between imprisonment and recidivism, estimate the amount of crime that was prevented when felons were imprisoned rather than placed on probation, and discuss the costs to the criminal justice system to achieve that reduction in crime. The findings suggest the following: (1) The prisoners had higher recidivism rates than the probationers, both across crime types and in the aggregate. However, the prisoners' crimes were no more serious than the probationers', nor was there a significant difference in the length of time before their first filed charge. (2) The prisoners committed 20 percent fewer crimes than the probationers during the three years following their convictions. (3) The criminal justice system spent about twice as much on supervising and reprocessing prisoners as it did on probationers over the three-year period.

Book excerpt: A collection of information about what has happened in California since the determinate sentencing law substantially changed courtroom procedures for determining sentences and set a policy designed to assure more just, uniform sentencing practices. The state legislature has assumed direct control of sentencing, establishing definite terms for specified crimes. Judges determine the length of prison terms by selecting among defined ranges and state reasons for selected sentences. The Adult Authority and Women's Board was eliminated and replaced with the Community Release Board which reviews sentencing disparity. One result has been a sharp increase in the commitment rate to prison; between 1977 and 1978 there was a 12 percent increase in the felon population in prison. Proposals for further research include studies of the central role of the legislature in criminal sentencing; correctional programs and security; court implementation of sentencing policy; and the effects of prosecutorial discretion.

She illustrates how dynamic systems simulation modeling is used to both examine "possible futures" under a variety of sentencing structures and sentencing policy alternatives, including narrowing "strike zones" and the early release of elderly offenders, in order to more effectively target the dangerous criminals these policies promise to remove from society via incarceration.
