In making the selection, variety, as well as utility, has been consulted. Some of the selected articles are on constitutional principles of vital importance - some on interesting questions of legislation and political economy - some on general jurisprudence - and others literary, bio graphic, and historic. The author, not desiring such a publication, during his life, yielded his consent to it now, as he informed the Publisher, chiefly for the purpose of preserving fugitive writings, which he desires to save and transmit to his posterity; and he is, therefore, permitted to dedicate to his children a volume which the Publisher hopes, that not only they, but the Public, and especially of Kentucky, will find to contain sound principles, interesting facts, and wholesome counsels. The mechanical execution is not, altogether, as satisfactory as was desired and expected. Typographical errors have resulted from accident and haste. But, while most of these are too minute for a special reference to them, only a few pervert or obscure the sense. One of the later may be found in the fourth line of the first page, where Governor is misprinted for LIEUT.-Governor. Matter also, which the larger and more open style of ordinary book print, would have extended to at least 650 pages, having been compressed into only 402 pages, the volume is neither as readable, nor as attractive to the taste as it might, at no greater cost, have been made. But, with all its faults, it is submitted to a generous public, who will be concerned more for the substance than the form - the body than the drapery. This strip of pasture is a hundred years long; its breadth may not be politely questioned! For the backward-looking and for the forward-looking students of American literature, not its merely browsing readers, he has wrought a service of larger and more lasting account. Thus Mr. Townsend's work and the work of his fellow-craftsmen are all stations on the long road but the right road. They are aids to the marshalling of the American commonwealths at a great meeting-point of the higher influences of our nation. Now, already American literature has long been a subject in regard to which a library of books has been written. The authors of by far the most of these books are themselves Americans, and they have thus looked at our literature and at our civilization from within; the authors of the rest are foreigners who have investigated and philosophized from the outside. Altogether, native and foreign, they have approached their theme from divergent directions, with diverse aims, and under the influence of deep differences in their critical methods and in their own natures. But so far as the writer of these words is aware, no one of them either native or foreign has ever set about the study of American literature, enlightened with the only solvent principle that can ever furnish its solution.

Universities and their faculty owned people-sometimes dozens of people-and profited from their labor while many slaves endured physical abuse on campuses. As Alfred L. Brophy shows, southern universities fought the emancipation movement for economic reasons, but used their writings on history, philosophy, and law in an attempt to justify their position and promote their institutions. Indeed, as the antislavery movement gained momentum, southern academics and their allies in the courts became bolder in their claims. Some went so far as to say that slavery was supported by natural law. The combination of economic reasoning and historical precedent helped shape a southern, pro-slavery jurisprudence. Following Lincoln's November 1860 election, southern academics joined politicians, judges, lawyers, and other leaders in arguing that their economy and society was threatened. Southern jurisprudence led them to believe that any threats to slavery and property justified secession. Bolstered by the courts, academics took their case to the southern public-and ultimately to the battlefield-to defend slavery. It argues that these legal scientists viewed the realm of law as the means through which they could express their hopes and fears associated with the social and cultural promises and perils of the early republic.
