Book excerpt: This report looks at the proposal from the European Commission to introduce a price cap on roaming charges for using mobile phones across the EU. It concludes that there is evidence of a market failure in roaming charges and, because the service is cross-border in nature, it is appropriate for action to be taken at the Community level. However the Committee has some reservations about the Commission's proposal and favour regulation at the wholesale end rather charges to the retail customer. It thinks that regulation based on the average wholesale price would allow companies to offer a range of charges, provide a competitive framework and avoid market rigidities. The Committee believes the regulation should apply for a minimum amount of time and there should be a 'sunset clause'. The proposals are limited to voice messages but there are also market abuses in data roaming and the Commission should consider extending the regulations to these services.
