Book excerpt: Academic Paper from the year 2019 in the subject Law - Civil / Private / Trade / Anti Trust Law / Business Law, grade: 75% (B+ equivalent), University of Melbourne (Melbourne Law School), course: Resources Joint Ventures, language: English, abstract: This research paper attempts to unpack and analyse various viewpoints and judicial pronouncements on the issue of a separate legal status for Joint Venture vis-à-vis Partnership in some jurisdictions such as Australia, Canada, England, New Zealand and the United States. The paper will aim to simplify, as much as possible, the meaning and types of Joint Venture and argue in favour of a regulatory statute for Joint Ventures, with special reference to Resources Joint Ventures as obtainable in Australia and New Zealand. In doing so, the paper will set out the contexts and legal parameters that embody the concept of Joint Venture. Joint Venture statutes are gradually becoming necessary bearing in mind the ever-increasing rate of cross-border transactions, as well as international activities towards the harmonisation and codification of legal principles and their applications into a single legal framework, which started before the turn of the twenty-first century and have intensified since then.

Book Rediscovering the Law of Negligence

Download or read book Rediscovering the Law of Negligence written by Allan Beever and published by Bloomsbury Publishing. This book was released on 2007-05-30 with total page 562 pages. Available in PDF, EPUB and Kindle. Book excerpt: Rediscovering the Law of Negligence offers a systematic and theoretical exploration of the law of negligence. Its aim is to re-establish the notion that thinking about the law ought to and can proceed on the basis of principle. As such, it is opposed to the prevalent modern view that the various aspects of the law are and must be based on individual policy decisions and that the task of the judge or commentator is to shape the law in terms of the relevant policies as she sees them. The book, then, is an attempt to re-establish the law of negligence as a body of law rather than as a branch of politics. The book argues that the law of negligence is best understood in terms of a relatively small set of principles enunciated in a small number of leading cases. It further argues that these principles are themselves best seen in terms of an aspect of morality called corrective justice which, when applied to the most important aspects of the law of negligence reveals that the law - even as it now exists - possesses a far greater degree of conceptual unity than is commonly thought. Using this method the author is able to examine familiar aspects of the law of negligence such as the standard of care; the duty of care; remoteness; misfeasance; economic loss; negligent misrepresentation; the liability of public bodies; wrongful conception; nervous shock; the defences of contributory negligence, voluntary assumption of risk, and illegality; causation; and issues concerning proof, to show that when the principles are applied and the idea of corrective justice is properly understood then the law appears both systematic and conceptually satisfactory. The upshot is a rediscovery of the law of negligence.

Book Neoliberalism Revisited

Download or read book Neoliberalism Revisited written by Gerardo Otero and published by Routledge. This book was released on 2018-05-04 with total page 283 pages. Available in PDF, EPUB and Kindle. Book excerpt: Having unilaterally opened its borders to international competition and foreign investment in the mid-1980s, Mexico has become one of the world's leading proponents of economic liberalization. Nevertheless, as the recent uprising of native peoples in Chiapas has made clear, economic reforms are not universally welcomed. This book addresses the challenges brought about by the restructuring of the Mexican economy at a time when-multiple organizations of civil society are demanding a democratic political transition in a system that has been dominated by one party for nearly seventy years. The contributors identify the key social and political actors—both domestic and international—involved in promoting or resisting the new economic model and examine the role of the state in the restructuring process. They explore such questions as: In what ways is the state itself being reconstituted to accommodate the demand for change? How have Canada and the United States responded to the increased internationalization of their economies? What are the challenges and prospects for transnational grassroots networks and labor solidarity? Answers are provided by scholars from anthropology, economics, history, political science, and sociology, all of whom promote interdisciplinary approaches to the issues. Each chapter traces the structural transformations within the central social relationships in Mexican society during the last decade or so and anticipates future consequences of today's changes.
