Le fedi religiose hanno un ruolo nello sviluppo dei sistemi giuridici contribuendo alla formazione di una scala di valori e di uno statuto ontologico dell’essere umano.È evidente che tra tutti i comportamenti umani negli spazi del vivere, le religiosità siano in una posizione di preminenza per il ruolo sociale che esse rivestono, in quanto chi crede persegue una finalità escatologica che potrebbe condurlo a conflitti di lealtà. La Costituzione dedica esclusivamente al fenomeno religioso ben 4 articoli, il 7, l’8, il 19 ed il 20, ed anche l’art. 3 sul cd. “principio di eguaglianza” che esclude qualsiasi possibilità di discriminazione per ragioni religiose, nonché gli artt. 2 e 18 sulla libertà e promozione delle formazioni sociali ove si esplica la personalità dell’individuo. La “laicità” è poi inserita tra i principi supremi del nostro ordinamento come un prisma indefettibile attraverso il quale leggere ogni singola situazione giuridica, seppure nel doveroso rispetto per le differenze culturali. Il nostro sistema giuridico si caratterizza per una laicità fattiva, operativa, collaborativa, attenta cioè ai valori ed alle diverse culture in gioco, nel rispetto di ogni fede religiosa. Tutto ciò si traduce in un reticolo di norme speciali, interpretazioni dottrinali, decisioni giurisprudenziali che formano il multicolor diritto vivente sul fenomeno religioso. Per districarsi in un sistema così complesso si rende anche necessario tradurre l’alterità mediante l’elaborazione di un lessico giuridico condiviso attraverso il nuovo “diritto interculturale”. Senza un’adeguata attenzione ai profili cultural religiosi non si possono correttamente applicare gli istituti giuridici che l’ordinamento propone perché sarebbero privi della loro effettività.Il Volume, oltre agli aspetti istituzionali, affronta e risolve anche in prospettiva professionale questioni come le forme organizzative religiose, il patrimonio degli enti ecclesiastici, le osservanze religiose, i dati sensibili, le disposizioni anticipate di trattamento, la tutela “positiva” della libertà religiosa, la trascrizione dei matrimoni religiosi, la delibazione delle sentenze ecclesiastiche, le unioni civili, la libertà religiosa nella famiglia e la kafalah.
