L’analisi è stata estesa anche ad ipotesi - i reati paesaggistico-ambientali - che a stretto rigore non rientrano nell’ambito specificamente urbanistico; per la stessa ragione vengono trattati anche gli imprescindibili profili processuali (sequestro del manufatto abusivo, costituzione di parte civile e confisca penale) della materia in esame, e anche l’articolata disciplina della sanatoria delle opere abusive. L’ultimo capitolo, poi, approfondisce uno degli aspetti più complessi e tormentati dell’intera materia urbanistico-edilizia e cioè quello relativo all’ipotesi di attività edificatoria posta in essere con permesso di costruire (non mancante ma) illegittimo. Con ampi richiami al variegato panorama delle elaborazioni dottrinali e degli indirizzi giurisprudenziali più recenti (soprattutto della Suprema Corte di Cassazione e della Corte europea dei diritti dell’uomo), oltre che dei fondamentali interventi correttivi della Corte Costituzionale: tutto ciò conferisce al volume una duplice valenza, teorica e pratica, che lo rendono un utile strumento tanto per lo studioso quanto per l’operatore del diritto. L’abbondante casistica giurisprudenziale risulta non solo aggiornata, ma anche completa, consentendo un’esauriente ricostruzione degli istituti giuridici trattati. Notevole rilievo viene dato anche all’analisi del dato normativo e soprattutto dei più recenti interventi riformatori, rendendo il volume un utile ed aggiornato strumento operativo, la cui consultazione è resa particolarmente agevole da un ricco indice analitico.
