Book excerpt: The Bureau of Justice Statistics' (BJS) National Crime Victimization Survey (NCVS) measures the rates at which Americans are victims of crimes, including rape and sexual assault, but there is concern that rape and sexual assault are undercounted on this survey. BJS asked the National Research Council to investigate this issue and recommend best practices for measuring rape and sexual assault on their household surveys. Estimating the Incidence of Rape and Sexual Assault concludes that it is likely that the NCVS is undercounting rape and sexual assault. The most accurate counts of rape and sexual assault cannot be achieved without measuring them separately from other victimizations, the report says. It recommends that BJS develop a separate survey for measuring rape and sexual assault. The new survey should more precisely define ambiguous words such as "rape," give more privacy to respondents, and take other steps that would improve the accuracy of responses. Estimating the Incidence of Rape and Sexual Assault takes a fresh look at the problem of measuring incidents of rape and sexual assault from the criminal justice perspective. This report examines issues such as the legal definitions in use by the states for these crimes, best methods for representing the definitions in survey instruments so that their meaning is clear to respondents, and best methods for obtaining as complete reporting as possible of these crimes in surveys, including methods whereby respondents may report anonymously. Rape and sexual assault are among the most injurious crimes a person can inflict on another. The effects are devastating, extending beyond the initial victimization to consequences such as unwanted pregnancy, sexually transmitted infections, sleep and eating disorders, and other emotional and physical problems. Understanding the frequency and context under which rape and sexual assault are committed is vital in directing resources for law enforcement and support for victims. These data can influence public health and mental health policies and help identify interventions that will reduce the risk of future attacks. Sadly, accurate information about the extent of sexual assault and rape is difficult to obtain because most of these crimes go unreported to police. Estimating the Incidence of Rape and Sexual Assault focuses on methodology and vehicles used to measure rape and sexual assaults, reviews potential sources of error within the NCVS survey, and assesses the training and monitoring of interviewers in an effort to improve reporting of these crimes.

They effectively used international humanitarian law and put on trial some of the accusers. Rape and sexual violence against women during times of war has gained recognition as war crimes and crimes against humanity. However, treating rape as a war crime and prosecuting the accusers for crimes against humanity has not prevented these crimes from reoccurring. In order to prevent this horrific crime from occurring, war rape must be consider a violation of the most fundamental rights, human rights. Human rights do not apply to women. The language of human rights creates the illusion that everyone is equal before the law, regardless of gender. It disguises the reality of unequal gender power relations that affects all societies. When addressing the crime of rape during times of conflict, the concept of equality means much more than treating all persons in the same way. Human rights activists need to address sexual violence against women as an infringement of human rights, but the only way to do that is to challenge the belief that human rights provisions adequately address women’s rights. Activists must advocate to expand human rights laws and build human rights standards to include gender specific crimes. Rape and all forms of sexual violence against women need to be clearly stated as a human rights provision. The acceptance of violence against women during times of conflict, as an abuse of human rights will provide activists with access to the ruling by international law. Because it would be universally held to have political weight, it will provide a useful set of tools. Using these tools, women can demand the State’s and international protection, prevention against this horrific crimes and retribution against the perpetrators of abuse. To advocate human rights is to demand that the human dignity of all people be respected. Therefore, no women should be subject to any form of torture, degrading treatment of inhuman treatment.

Book excerpt: Research on violence against women has exploded in the past 20 years, particularly in the areas of intimate partner violence and sexual assault. Despite this outpouring of research, many gaps exist in our understanding of violence against women. For instance, reliable information on minority women's experiences with violence is still lacking. Few empirical data exist on the relationship between different forms of violence against women, such as victimization in childhood and subsequent victimization. Finally, empirical data on the consequences of violence against women, including their injury rates and use of medical services, are lacking. To further understanding of violence against women, the National Institute of Justice and the Centers for Disease Control and Prevention jointly sponsored, through a grant to the Center for Policy Research, a national survey that was conducted from November 1995 to May 1996. The National Violence Against Women (NVAW) Survey sampled both women and men and thus provides comparable data on women's and men's experiences with violent victimization. Respondents to the survey were asked about: Physical assault they experienced as children by adult caretakers; Physical assault they experienced as adults by any type of assailant; Forcible rape and stalking they experienced at any time in their life by any type of perpetrator. Respondents who disclosed that they had been victimized were asked detailed questions about the characteristics and consequences of their victimization, including injuries they sustained and their use of medical services. This NIJ Research Report presents findings from the NVAW Survey on the prevalence and incidence of rape, physical assault, and stalking; the rate of injury among rape and physical assault victims; and injured victims' use of medical services. The data show that violence is more widespread and injurious to women's and men's health than previously thought—an important finding for legislators, policymakers, intervention planners, and researchers as well as the public health and criminal justice communities.
